Please see the attached VCP application and proof of payment of the application fee for Phase 2 of The Other Side
Village development for your review. I did not attach copies of the historical assessment reports, as they were previously
submitted to you. Let me know if that is a problem and they need to be resubmitted.

Thanks. I have started processing the application and initiating the eligibility review.
For the EA which is required with the application, the application notes "Please refer to previously-submitted
information for TOSV Phase 1." In this case there are several EPA documents and a few documents that were submitted
summarizing independent investigations prior to the VCP. To avoid confusion and ensure consistency, please
specify which documents TOSA wants to include as part of the EA. I believe we can make an electronic copy from the
current file and then transfer them to a new file for this project, but I don't want to make any assumptions. I will use the
response to this email as a guide.
Also, I am assuming that TOSA wants to engage with us first before sampling (meaning enter into the VCA)? Is this
correct or has sampling already commenced? I have included an example EA from a site that had no data, but suspected
impacts as they initially entered the VCP. Please draft and include a similar Narrative document with your response. That
should fulfill the EA requirements with the additional information requested above. No need to include all the figures as
you already provided one with the application.

Thank-you for the review of the documents.
Please confirm for the team that once we have submitted the VCP Application, we cannot perform site
characterization work without agency oversight. If we want to collect samples to document site conditions,
we would need to do that before formally entering into the VCP and finalizing our application. Once we
submitted our application, we need to wait to collect site data.

Once an application is submitted, the Applicant should be working with us through a signed VCA. If the customer wants
to proceed and gather data on their own initially (say the application was submitted premature), they can ask us to hold
off on the application until they are ready to work with us. We discussed the pros and cons of both approaches in the
meeting. At this point, maybe the best approach is to proceed with the VCA while you guys develop the QAPP and SAP.

Attached is the requested EA Letter to complete the VCP Application. Based on a review of the documents
included in the Phase I of The Other Side Village (TOSV) file on the UDEQ Interactive website, we will
request to include all available documents in our submission for the Phase 2 of TOSV property enrollment
into the VCP.
Terracon will draft a Site Characterization Work Plan (Work Plan) and use the existing QAPP approved for
Phase I of TOSV to complete the work outlined in the Work Plan. We will wait for confirmation of acceptance
into the VCP and review of the Work Plan to characterize the site by the VCP before implementing any site
work. No sampling has been performed or will be performed until review and approval of the Work Plan by
the agency.
