Dear Daniel Traces: On March 13, 2024, the Division of Drinking Water (the Division) received your request for a renewal of the existing temporary exception to Rules R309-545-15(1), Inverted Ventand R309-545-14(1) &(3), Access Opening Height and Locking Device, for the Zone 1W - 4 MG Storage Tank (identified as ST002 in the Division database). The applicable portions of these rules are as follows: R309-545-15(1), Inverted Vent, states that tank vents shall be downturned 2 inches below any opening, with the discharge 24 inches above the earthen covering, and shall be fitted with No.14 mesh, protected with a larger screen (No. 4). R309-545-14(1) and (3), Access Opening Height and Locking Device,states that access openings shall be elevated 18 inches above buried structures, with a solid gasketed shoebox lid downturned 2 inches and locked. Exception Background The venting of this tank is done through screened vents located 24 inches above the tank roof that are protected by a downturned hood on the outside of the access hatch walls. Within the hood, there is a waterstop that extends 2 inches above the opening of the hood. The 12-inch diameter standpipe vent is screened on the vertical opening and is located within an additional access hatch. The intent of this rule is met with the design because the standpipe is located inside of the secured access hatch. The design of the access hatch includes a larger outer hatch with a locking, gasketed shoebox lid, whose opening is 3 feet above the backfill over the buried roof. Inside of the larger outer hatch is a smaller inner hatch with a gasketed bolted lid on top of a 6-inch curb. The intent of this rule is met with the outer hatch meeting these requirements. Exception Request The basis for your request for exceptions to the storage tank air vent and access hatch design rules in R309-545, is that the alternate designs stated above provide equivalent protection to public health and meet the intent of the rules. On this basis, temporary exceptions to Rules R309-545-15(1), Inverted Ventand R309-545-14(1) &(3), Access Opening Height and Locking Device,are herebygranted for the Zone 1W - 4 MG Storage Tank (ST002) subject to the following conditions: This Temporary Exception expires onApril 1, 2027. Conduct ongoing site assessments of the air vent and access hatch to verify the alternate design meets the intent of the rule. You will be required to re-submit an exception request along with confirmation that all conditions outlined in this temporary exception have been fulfilled and obtain an exception renewal before April 1, 2027. Exceptions granted by the Division include an expiration date to ensure that the basis and conditions for granting the exception are verified periodically and that the drinking water quality remains protected. After receiving your request, the Division will determine whether this exception can be re-issued. Failure to request the re-evaluation of this exception and obtain an exception renewal by April 1, 2027, will result in the activation of the deficiencies related to inadequate design of the air vent and access opening. This Temporary Exception may be rescinded at any time if new evidence indicates that the conditions of this exception are no longer being met or a public health risk exists due to this exception.The issuance of this exception temporarily resolves your water system’s deficiencies for the storage tank air vent and access hatch (Deficiency codes V008 and V005).
