Subject:Temporary Exception to R309-545-13, Tank Overflow for the Storage Facility (ST001); Goshen Town Water System, System #25013, File #13656
This Temporary Exception Expires on April 16, 2027.
Dear Rachel Pena:
On March 15, 2024, the Division of Drinking Water (the Division) received your request for an exception to Rule R309-545-13 regarding tank overflow for the Storage Facility (ST001).
According to this rule, all water storage tanks shall be provided with an overflow that discharges at an elevation between 12 and 24 inches above the ground surface or the rim of the
receiving basin. The discharge shall be directed away from the tank and shall not cause erosion.
Your request for an exception to R309-545-13, Tank Overflow, is based on the following information:
This temporary exception request only relates to the tank overflow, which discharges separately from the tank drain.
The tank overflow for the Storage Facility (ST001) discharges directly to the adjacent irrigation tanks. The air break vault is being constructed to prevent any potential cross-connection
between the Storage Facility (ST001) and the irrigation tanks.
The tank overflow discharges below the rim of the air break vault due to minimal elevation difference between existing pipelines and water system facilities.
The tank overflow located inside of the Storage Facility (ST001) is equipped with a funnel. The elevation of the funnel rim is approximately 12 inches above the rim of the air break
vault.
A #4 screen and Tideflex valve was installed on the end of the Storage Facility (ST001)
tank overflow line as it enters the air break vault. The invert elevation of the tank overflow line at this point is 4,732.87 feet.
An 8-inch diameter overflow pipe will be installed inside of the air break vault with an invert elevation of 4,732.03 feet, which is directly above the 10-inch diameter outlet pipe with
an invert elevation of 4,731.15 feet. The 8-inch diameter overflow pipe is intended to capture any excess water within the air break vault and convey it to the existing 6-inch diameter
drain and overflow line for the irrigation tanks at an elevation of approximately 4,729 feet.
Exception Request
Your request for an exception to R309-545-13, Tank Overflow, for the Storage Facility (ST001) is
based on minimal elevation difference between existing pipelines and water system facilities. Also, theair gap vault has several measures in place to prevent a potential cross-connection
including the following:
An oversized 10-inch outlet pipe to allow additional flow out of the air break vault.
An 8-inch overflow pipe directly above the 10-inch outlet pipe to capture any excess flow.
A Tideflex valve on the 8-inch tank overflow line.
The air gap vault will be equipped with a standard manhole lid which is approximately 12
inches below the rim of the Storage Facility (ST001) overflow funnel.
If both the 10-inch outlet pipe and 8-inch overflow pipe become blocked and the air break vault fillsthen the Tideflex valve will inhibit backflow and the water will overflow the air
gap vault through the standard manhole lid meeting the intent of rule R309-545-13, Tank Overflow.
On this basis, an exception to R309-545-13, Tank Overflow, is hereby granted for the Storage Facility (ST001) with the following conditions:
This exception expires on April 16, 2027.
Ongoing Site Assessment
Conduct routine inspections of the air break vault to visually inspect and document any potential backflow risks, check the Tideflex valve is working properly, and take actions if needed.
Document ongoing site assessments through record keeping. Maintain the records as part of your water system’s Cross Connection Control Program.
Continue to comply with all monitoring and reporting requirements.
You will be required to re-submit an exception request along with confirmation that all conditions outlined in this exception have been fulfilled and obtain an exception renewal before
April 16, 2027.
Exceptions granted by the Division include an expiration date to ensure that the basis and conditions for granting the exception are verified periodically and that the drinking water
quality remains protected. After receiving your request, the Division will determine whether this exception can be re-issued.
Failure to request the re-evaluation of this exception and obtain an exception renewal by April 16, 2027, will result in the activation of the deficiency related to not having an air
gap of 12 to 24 inches between the overflow and the ground surface in compliance with Rule R309-545-13, Tank Overflow.
This exception only applies to the existing Storage Facility (ST001) and will not apply if this tank is replaced in the future.
This exception may be rescinded at any time if new evidence indicates that the conditions of this exception are no longer being met or a public health risk exists due to this exception.
