Dear Rachel Pena: On March 15, 2024, the Division of Drinking Water (the Division) received your request for an exception to Rule R309-515-7(7)(d), Spring Access Hatches for the Ercanbrack Spring (WS001). According to this rule, spring box access hatches shall meet the requirements in R309-545, including being elevated 18 inches above any earthen covering and having a close-fitting solid shoebox type cover that extends down around the frame at least 2 inches and furnished with a gasket. Your request for an exception to Rule R309-515-7(7)(d), Spring Access Hatches, is based on the following information: The Ercanbrack Spring (WS001) is identified as WS001 in the Division’s database. The Ercanbrack Spring (WS001) is a horizontal drain tunnel with a vertical opening (door), which is not a typical horizontal spring access hatch. The existing Ercanbrack Spring (WS001) is a horizontal drain tunnel with a vertical opening (door), which is not a typical horizontal spring access hatch. To meet the intent of the spring access requirement, the design includes a vertical access opening with a steel frame protruding 4 inches out from the wall with a 2-inch lip with a gasket to completely seal off the opening at the face of the wall. Exception Request Your request for an exception to Rule R309-515-7(7)(d), Spring Access Hatches, for the Ercanbrack Spring (WS001) is based on the spring access configuration not being consistent with the rule. However, the spring access point is a sealed door with a 2-inch lip which meets the intent of the rule. On this basis, an exception to R309-515-7(7)(d), Spring Access Hatches, is hereby granted for the Ercanbrack Spring (WS001) with the following conditions: This exception expires on April 16, 2027. Continue to comply with all monitoring and reporting requirements. You will be required to re-submit an exception request along with confirmation that all conditions outlined in this exception have been fulfilled and obtain an exception renewal before April 16, 2027. Exceptions granted by the Division include an expiration date to ensure that the basis and conditions for granting the exception are verified periodically and that the drinking water quality remains protected. After receiving your request, the Division will determine whether this exception can be re-issued. Failure to request the re-evaluation of this exception and obtain an exception renewal by April 16, 2027, will result in the activation of the deficiency related to not having a spring access hatch in compliance with Rule R309-515-7(7)(d), Spring Access Hatches. This exception only applies to the existing Ercanbrack Spring (WS001) and will not apply if this source is replaced in the future. This exception may be rescinded at any time if new evidence indicates that the conditions of this exception are no longer being met or a public health risk exists due to this exception. The issuance of this exception temporarily resolves your water system’s deficiency related to S003. An updated IPS report is available at https://waterlink.utah.gov.
