Dear Mr. Shepherd:
The Division of Environmental Response and Remediation (DERR) project manager has reviewed
the file for this 2022 surface release from an aboveground petroleum storage tank release and recommends
no further action (NFA) at this time. This recommendation applies only to the specific Release Site ODU
and is based on the information supplied by you or your consultant.
The information submitted indicates that petroleum contamination remains as a result of this release.
Specifically, remaining soil concentrations exceed the DERR Petroleum Storage Tank Initial Screening
Level (ISL) cleanup standards in landfarmed soil along a roadway at the southeast corner of your remote
feedlot. The contamination is in surface soils placed along the edges of your private driveway that are not
currently considered a threat to human health or the environment according to Utah Admin. Code R311-211.
This evaluation is based on current land usage, exposure pathways, potential receptors, and other site-specific
risk characteristics. In the future, if changes to these characteristics create a threat to human health or the
environment, additional corrective action may be required.

Levan AST Diesel Spill (B Shepherd), located at 25 South 200 East, Levan, Utah
Facility Identification No. 2000759, Release Site ODU
A release was reported on April 4, 2022 when the end of an APST burst during refueling, releasing
1500 gallons of red-dyed diesel to the soil. The soil was scraped up, confirmation samples were below
of town, as allowed by the local health department. Over 1300 tons of impact soil were removed.
Confirmation samples in 2024 were below Tier 1 for DRO.
