Attn: Mr. Aaron Leonard aleonard@holidaytruckingllc.com Subject: Warning Letter Holiday Trucking, L.L.C., Gasoline discharge to Burch Creek DEQ Environmental Incident Report No. 19218 Dear Mr. Leonard: This Warning Letter is in response to the unlawful discharge of gasoline to Burch Creek on August 8, 2024, resulting in a fish kill. The discharge was associated with a fuel release at the Gas Stop South Ogden facility located at 925 Chamber Street in South Ogden, Utah. The Division was notified of this incident on August 8, 2024 and responded on site. The incident was recorded in the Department’s Environmental Incidents Database as Incident Report No. 19218 You are hereby officially notified that the unlawful discharge is in violation of the Utah Water Quality Act in Utah Code § 19-5-107 which states: …it is unlawful for any person to discharge a pollutant into waters of the state or to cause pollution which constitutes a menace to public health and welfare, or is harmful to wildlife, fish or aquatic life, or impairs domestic, agricultural, industrial, recreational, or other beneficial uses of water, or to place or cause to be placed any wastes in a location where there is probable cause to believe it will cause pollution. Page 2 Warning Letter Utah Code § 19-5-115 provides that violations of the Water Quality Act may be subject to a civil penalty of up to $10,000 per day of violation. Be advised that future violations of this nature may be subject to formal enforcement action which may result in monetary penalties and/or other sanctions.
