HomeMy WebLinkAboutDSHW-2024-008281AugustXX, 2024 Justin Anderson, P.E., Public Services Director Ogden City Corporation 2549 Washington Boulevard Ogden, UT 84404 RE:Request for Information – Closure Standard Design Requirements – Moulding & Sons Landfill Dear Mr. Anderson: This Request for Information is being sent to your attention as a representative of Ogden City Corporation (the Respondent).According to the Division of Waste Management and Radiation Control’s (Division) records, you are the designated contact person for the Respondent. On September 4, 2024, a representative of the Division conducted a compliance evaluation inspection at the Respondent’s Moulding & Sons Landfill (Landfill). The scope of the inspection was to verify compliance with Utah Administrative Code R315 and the Utah Solid and Hazardous Waste Act (the Act). The Division representative was informed of an area within the Landfill boundary and along the Ogden River potentially indicative of fluvial erosion. During the inspection, the landfill cap of the area appeared to be disturbed and no longer intact. R315-303-3(4)(a)(ii) states the standard design of the final cover shall consist of a layer to minimize erosion. Specifically, this layer should consist of at least 6 inches of soil capable of sustaining vegetative growth placed over the compacted soil cover and seeded with grass, other shallow rooted vegetation or other native vegetation, or other suitable materialapproved by the Director of the Division (Director). Additionally, R315-303-3(4)(b)(ii) requires that erosion channels deeper than 10% of the total cover thickness shall be repaired as soon as possible following their discovery for any earthen final cover at a landfill. Based on observations and information obtained during the inspection, the Director is issuing this Request for Informationto obtain more information detailing the nature and extent of the disturbed landfill cap and remedial measures taken or to be taken to protect human health and the environment. Within 30 days of the date of this Request for Information, please submit the following requested documentation to the Director: An assessment report describing the nature and extent of the noncompliance or violation and the remedial measures taken or to be taken to protect human health and the environment, and to eliminate the noncompliance or violation. Upon receipt and review of the assessment report, the Director may order the Permittee to perform appropriate remedial measures, such as the development of a site remediation plan for approval by the Director. The matters addressed above, including each letter identified above,all responses, and associated corrective actions, will become part of the compliance record and may beconsidered in connection with future enforcement matters.
