Dear Mr. Dockstader:

On May 8, 2024, the Division of Environmental Response and Remediation (DERR)
received an Emergency Response and Remedial Services Report for the above-referenced site.
Upon review of this document, the DERR cannot accept the submitted work. The DERR has been
informed that the sampling was not collected by a Utah-certified petroleum storage tank (PST)
groundwater and soil sampler/consultant as outlined in Utah Admin. Code R311-205. The certified
sampler listed on the chain-of-custody record has indicated they did not collect the samples and
have never been to the Border Store site; this implies that the environmental professional has
falsified documents in this report. New soil data must be collected by a Utah-certified groundwater
and soil sampler/consultant following the sampling protocol outlined in Utah Admin. Code R311-
205.

In 1994, the Utah Legislature amended the Utah Underground Storage Tank Act to require
environmental consultants to be certified by the DERR to work on leaking petroleum storage tank
sites. All reports documenting abatement, investigation, or corrective action that occur must be
signed by a Certified PST consultant. To become certified, a consultant must meet a combination
of experience, training, and education requirements and pass a certification examination. The
certification is for individuals and does not certify a firm or company.

If you have an environmental consultant performing the work described above, you should
confirm that they are certified. Certified consultants are issued cards and certificates verifying their

certification. When asked, the consultant must display proof of their certification. If they are not
currently certified, you will either need to have them become certified before initiating, continuing,
or completing any work at your release site or replace them with a certified individual. A list of
certified samplers/consultants is attached for your reference.

Samples must be re-collected to determine the full extent and degree of petroleum-
contaminated soils and groundwater. All environmental samples must be collected by a Utah-
certified groundwater and soil sampler/consultant following the sampling protocol outlined in Utah
Admin. Code R311-205. The report associated with these requirements must be submitted to our
office within 90 days of the receipt of this letter. Environmental samples must be analyzed for diesel
using the methods indicated in the enclosed Table of Analytical Methods for Sampling.

Additionally, the DERR must be notified at least 7 days in advance of any sample collection.
This ensures that the DERR staff or other authorized personnel have sufficient time to mobilize to
the site to oversee the field activities.
