The plan that was provided appears to reflect the format for a Preliminary Evaluation Report (PER) not the format for a "full" Drinking Water Source Protection (DWSP) plan. I've attached the Ground-Water User's Guide which has a lot of information on preparing plans. The standard report format for a DWSP plan starts on Page 78. Do you want me to log the plan in that was submitted with the OP request and staff will reach out with comments upon review? Or would you like to revise what has been prepared first and re-submit? Concurrence of the DWSP plan is not necessary for an OP, but the PER indicated that the Weber County ordinance would be used in lieu of land use agreements to comply with R309-600-13(2)(d). So in order to obtain an OP, you will need to submit documentation that a map of the zones has been provided to Weber County. This can be as simple as forwarding or cc'ing me on an email that is sent with the map of the zones to Weber County. You should look at the Weber County ordinance to determine which entities within the county need to receive the information. Feel free to call me with any questions. I haven't reviewed the final DWSP plan that was submitted because it doesn't fulfill Division requirements. At a minimum the DWSP plan must be stamped by a licensed geologist or engineer before I will review it. Please take a look at my previous email for further information. My recommendation would be that you modify the plan following our standard report format and resubmit it for review. The plan submitted in January 2023 reflected the format for a Preliminary Evaluation Report (PER) not the format for a "full" Drinking Water Source Protection (DWSP) plan. I provided the Ground-Water User's Guide to Tyler and Brad but haven't received anything since. Brad and Tyler did submit a map of the final zones to Weber County to fulfill the source protection requirements necessary for an Operating Permit but we still need a full DWSP plan developed and submitted for review to the Division. Based on the mapping, Table 4-1, and the original exception request, existing sewer infrastructure is also located within zone one. Please confirm and update Table 3-1 to reflect the correct information. Section 4 - Identification and Assessment of Current Controls The existing sewer lines in zone one cannot be assessed as adequately controlled because they do not meet the criteria of R309-600-13(3). You need to come up with another control type for the sewer infrastructure outside of zone one since it is not constructed in accordance with R309-515-6(4). Typically, sewer infrastructure outside of zone one can be assessed as adequately controlled using Best Management & Pollution Prevention Practices if the sewer utility has an adequate leak detection program. The last exception request was from 2018 and has not been renewed. The conditions of the original exception have not yet been fulfilled and the Division now only grants temporary exceptions to rule, so the system needs to request a renewal of the exceptions to Rules R309-600-13(3) and R309-515-6(4). The Division will only be able to grant a conditional concurrence of the final DWSP plan. The conditions will be based on the completion of the strategies identified in the exception renewal request before the first update is due (12/31/2028). The original exception request (attached) was based on the placement of cured-in-place pipe (CIPP). The system is welcome to use that strategy as the basis for the renewal request. I thought it important to note that the Division has recently allowed other strategies for exceptions to these rules such as more frequent video inspections of the sewer infrastructure located within zone 1 and repair of any defects. Typically the video inspection needs to have already occurred, at least once, to bolster the case for the exception renewal. Please contact me with any questions. Dani and I will be meeting with the Assistant Director next week to discuss the exception request for the sewer line in zone 1. I will draft a concurrence letter that also addresses the exceptions once we've met with the Assistant Director. I had one question about the exception request. Has the sewer line that runs through zone 1 recently been inspected by video/camera? From the request, I understand that video inspections have been proposed every 5 years, but when was the sewer line last inspected? I imagine that the Assistant Director will want to know that information. The exception letter currently only states that the sewer line in zone one will be inspected.
