Dear Chad Gilgen,
NOVVA, Inc. (Novva), recently received a compliance advisory following a site visit conducted by the Utah
Division of Air Quality (UDAQ) on July 1, 2024. In the compliance advisory, UDAQ stated that Novva may be
in violation of UAC R307-401-5 and conditions I.3, II.A.2, and II.A.5 under Approval Order (AO) DAQE-
AN160660001-22, due to observation of unapproved equipment.
Novva has addressed all previously unapproved equipment through permitting actions submitted to UDAQ in
May of 2024. All previously unapproved equipment is now accounted for in the most up-to-date version of
Novva’s Approval Order, DAQE-AN160660003-24. As such, no further action from Novva can be taken at
this time.

The DAQ is in receipt of your response to the Compliance Advisory and will move forward with closing out the open
compliance action with an Early Settlement Agreement that should be sent out to NOVVA within the next 7-10 business
days.
