Dear Mr. Hannes:
With the receipt on November6, 1998, of the documentation that the financial assurAnce forclosure ancl
post-closure care costs at the Advanced Paving and Construction Class IVb Landfill is in effect and active,
the landfill permit can be issued. Enclosed is the Permit to operated the Class IVb Landfill located on your
property in Nerv Haven, Weber County.

Pcriodic inspections of the landfill will be conducted. Personnel fornr the Division of Solid and Hazardous

conditiorrs of the Perrlit and rhe Utah Solid Waste Perrnitting and Managentent Rules.
The Perrnit expires on the date shown on the cover sheet. If renerval is desired, Advanced Paving and
Construction must apply for renewal of the Perrnit 180 days prior to the expiration date.

CLASS IVb LANDFILL
Pursuant to the provisions of the Utah Solid and Hazardous Waste Act,TitIe 19, Chapter 6, Utah
Code Annotated (UCA) 1953, as amended (the Act) and the Utah Solid Waste Permitting and
Management Rules, Utah Administrative Code (UAC) R315-301 through 320 (the Solid Waste
Rules) adopted thereunder,
Advanced Paving and Construction
is hereby authorized to operate the Advanced Paving and Construction Class IVb Landfill in the
Southwest l/4 of Section 24, Township 6 North, Range 2 West, SaIt I*ke Base and Meridian, West
Haven, Weber County, Utah as specifically described and shown in the permit application.
The operation of the landfill is subject to the condition that Advanced Paving and Construction (the
Permittee) meet the requirements set forth herein.
All references to UAC R315-301 through 32O are to regulations that are in effect on the date that this
permit becomes effective.

TYPE OF PERMIT:Class IVb Landfill
PERMIT NUMBER:9810
LOCATION:The Advanced Paving and Construction IVb Landfill is located in the
Southwest Il4 of Section 24, Township 6 North, Range 2 West, Salt Lake
Base and Meridian, New Haven, Weber County, Utah as specifically
described and shown in the permit application.
Permit as used in this document is defined in Utah Administrative Code (UAC) R315-301-2(54).
The revised application, received August 28,1998, is incorporated by reference into this Solid Waste
Permit. All representations made in the permit application are part of this permit and will also
become part of the operating record of the Advanced Paving and Construction Class IVb Landfill.
Where differences in wording exist between this permit and the application, the wording of the
permit supersedes that of the application.
By this permit to operate, the Permittee is subject to the following conditions.
I. GENERAL COMPLIANCE RESPONSIBILITIES
A. General Operation
The Permittee shall operate the Class IVb Landfill in accordance with all
requirements of UAC R315-305, that a.re applicable to Class IVb Landfills, unless
otherwise noted in this permit. Any permit noncompliance or other noncompliance
which constitutes a violation of UAC R315-305 is grounds for appropriate
enforcement action.

B. Acceptable Waste
This permit is for the disposal of construction/demolition waste and inert waste
generated exclusively by Advanced Paving and Construction operations.
C. Prohibited Waste
No hazardous waste as defined by UAC R315-301-2(29); PCB's as defined by UAC
R315-301-2(52); household hazardous waste; conditionally exempt small quantity
generator hazardous waste as defined by UAC R3 1 5-2-5; household waste; municipal
waste; special waste; commercial waste; industrial waste; or construction/demolition
waste generated by anyone other than Advanced Paving and Construction may be
accepted at the landfill.
D. Inspections and Inspection Access
The Permittee shall allow the Executive Secretary of the Utah Solid and Hazardous
Waste Control Board or an authorized representative, including representatives from
the Weber/Ivlorgan Health Department, to enter and inspect, at reasonable times, the
landfill and any practice or operation regulated or required under this permit. A
record of any inspection may be made by photographic, videotape, electronic, or
other reasonable means.
E. Self Inspections
The Permittee shall, no less than quarterly, inspect the landfill site including the
fencing, gate, or other access controls and the storm water run-on/run-off controls.
A record of these inspections shall be maintained in the operating record.
F. Noncompliance
If monitoring, inspection, or testing indicates that any permit condition or any
applicable rule under UAC R315-301 through32O may be or is being violated, the
permittee shall promptly make corrections to the operation or other activities to bring
the facility into compliance with all permit conditions or rules. In the event of any
noncompliance with any permit condition or violation of an applicable rule, the
permittee shall promptly take any feasible action reasonably necessary to correct the
noncompliance or violation and mitigate any risk to the human health or the
environment. Actions may include eliminating the activity causing the
noncompliance or violation and containment of any waste or contamination using
bariers or access restrictions, placing of warning signs, or perrnanently closing areas
of the facility. The permittee shall: document the noncompliance or violation on the
operating record; notify the Executive Secretary of the Solid and Hazardous Waste

Control Board within 24 hours, or the next business day following the event; and
give written notice of the noncompliance or violation and measures taken to protect
public health and the environment within seven days. Within thirty days of the
occurrence of the event, the permittee shall submit, to the Executive Secretary, a
written report describing the nature and extent of the noncompliance or violation and
the remedial measures taken or to be taken to protect human health and the
environment and to eliminate the noncompliance or violation. Upon receipt and
review of the assessment report, the Executive Secretary may order the permittee to
perform appropriate remedial measures including development of a remedial plan for
approval by the Executive Secretary.
It shall not constitute a defense for the Permittee in an enforcement action that it
would have been necessary to halt or reduce the permitted activity in order to
maintain compliance with the conditions of this permit. Compliance with the terms
of this permit does not constitute a defense to actions brought under any other local,
State, or Federal laws.
tr. DESIGN AND CONSTRUCTION
A. Run-on and Run-off Control
Drainage channels and berms shall be constructed as specified in the permit
application. These channels and berms shall be maintained at all times to effectively
prevent run-on from the surrounding property and to prevent run-off of storm water
that has contacted waste from a 25-yew storm event.
M. LANDFILL OPERATION
A. Access Controls
At least one person, employed by Advanced Paving and Construction, shall be at the
landfill during all hours that the landfill is accepting waste. A trained employee of
Advanced Paving and Construction shall inspect the waste, either at the site of
generation or at the landfill, to prevent the disposal of unacceptable waste. The
landfill site shall be fenced and the entry gate shall be locked during the time the
landfill is not receiving waste.
B. Burning of Waste
Intentional burning of solid waste at the active face of the landfill is prohibited and
all accidental fires shall be extinguished as soon as possible. Combustible waste

disposed at the active face of the landfill shall be covered with a minimum of six
inches of soil as needed to avoid a fire hazard.
E. Waste Diversion
The Permittee may operate, at a location separated from the active area of the landfill,
a waste diversion site.
Recyclable materials may be accepted and stored in a separate diversion area
specifically established for these items. At least once each year, the stored recyclable
materials shall be removed form the diversion site. Stored metals that cannot be
recycled shall be disposed at a Class I or tr Landfill.
F. Recordkeeping
The Permittee shall maintain and keep on file, either at the landfill site or as part of
the Advanced Paving and Construction records, an operating record that shall
include: a copy of the permit including the permit application; the number of
vehicles entering the landfill each day of operation; an estimate of the weights or
volumes of waste received each day of operation; the types of waste received;
records of any inspections; and records of any noncompliance.
H. Reporting
An annual report shall be prepared and submitted to the Executive Secretary by
March 1 of each year for the most recent calendar or fiscal year of landfill operation.
The annual report shall include: the name and address of the facility; the calendar or
fiscal year covered by the report; an estimate of the annual quantity of waste disposed
in tons or volume in cubic yards; an estimate of the annual quantity of materials
recycled; the annual update of the closure and post-closure care costs and financial
assurance; any training program or procedures completed; and any other information
required by the Executive Secretary.
IV. CLOSURE REQUIREMENTS
A. Financial Assurance for Closure
Advanced Paving and Construction shall submit to the Executive Secretary, a Surety
Bond guaranteeing that the surety issuing the bond will perform closure and post-
closure care on behalf of Advanced Paving and Construction if Advanced Paving and
Construction fails to complete closure and post-closure care activities as specified in
the Permit and the permit application. The Surety Bond shall otherwise meet the

requirements of Subsection R315-309-3(4) and shall be up-dated each year as part
of the annual report as specified in Subsection R315-309-2(2).
B. Closure
The final closure of the landfill shall consist of leveling waste to the extent
practicable, covering with a minimum of two feet of earthen material, and seeding
with grass according to the closure plan contained in the permit application. The
Permittee shall also meet the requirements of UAC R3I5-302-2(6) by recording with
the Weber County Recorder, as part of the record of title, that the property has been
used as a landfill.
V. ADMINISTRATTVE REQUIREMENTS
A. Permit Modification
Modifications to this permit may be made by the Executive Secretary when necessary
as a result of new information or statutory or regulatory changes, or upon approval
by the Executive Secretary of the Permittee's request for modification. The Permittee
will be given written notice of any permit modification initiated by the Executive
Secretary.
B. Permit Transfer
This permit may be transferred to a new Permittee by meeting the requirements of the
permit transfer provisions of UAC R315-310-9.
C. Exoiration
An application for a permit renewal shall be made at least 180 days prior to the
expiration date, as shown on the signature (cover) page, of this permit. If a timely
renewal application is made but the permit renewal is not complete by the expiration
date, this permit shall continue in force until renewal is completed or denied.
D. Expansion
Any expansion of the landfill facility beyond the areas designated in the permit
application will require submittal of a new permit application in accordance with the
requirements specified in UAC R315-310-5. The Permittee may not begin
construction of any expansion until approval of the new permit is received from the
Executive Secretary.

E. Revocation
This permit is subject to revocation if any condition of the permit is not being met.
The Permittee will be notified in writing prior to any proposed revocation action and
such action will be subject to all applicable hearing procedures established under the
Solid Waste Rules and the Utah Afuninistrative Procedures Act (6346b, Utah Code
Annotated 1953, as amended).
