OnDecember 23,2019,theDivisionofWaterQuality(DWQ)issued a GroundWaterDischargePermit-By-Ruleand Construction Permit for the Waste Water Lagoon associated with the Cal-Maine Foods, Inc.
Delta Egg Farm Expansion, Millard County, Utah. The Waste Water Lagoon was constructed and an Approval to Use letter was sent out on November 16, 2020.
On December 20, 2024 DWQ received a renewal request from Gary Chapman, P.E. of Enviro-Ag Engineering, Inc. The documentation has been reviewed and the GroundWaterDischargePermit-By-Rule
is Renewed
Conditionsofthe Renewal
ThefollowingconditionsarerequiredunderthisPermit-By-Rule:The Waste Water Lagoon may only be used for wash water from the egg wash plant.Nothingelsemaybeputin thepond.CeaseoperationsandnotifyDWQimmediatelyifasheenorunusual
odorisdetectedonanyofthe pooled waterin thepond.
Ifanyofthesefactorschangebecauseofchanges in youroperationorfrom additionalknowledgeofsiteconditions,thispermit-by-rulemaynotapplyandyoushouldinformDWQimmediately.If future project knowledge
or experience indicates that a ground water quality is threatened bythis operation, the Director may require that you apply for a ground water discharge permit inaccordancewithUtah AdministrativeCode(UAC)
R317-6-6.2.C.
Thispermit-byruledeterminationiseffectiveforaperiodof5yearsfromthedateofthisletter.Prior to the end of this 5-year period, Cal-Maine Foods Inc. shall submit toDWQ a summary of the laboratory
analytical results from each of the annual waste water samples collected from the lagoon and request to renew the permit-by rule status.The request shall include a currentdescriptionoftheoperationandverificationoraffirmationthatsiteconditionshavenotchanged.
In evaluating the request, the Director may conduct a facility inspection and request additionalsamplesand informationasnecessary.Ifwecanbeoffurtherassistance,[e-mail][phone].
