Jordan,
Thank you again for sending us the Compliance Advisory dated December 11, 2024. We appreciate the opportunity to
correct our deficiency. We acknowledge the size of our stockpiles at the time of the inspection was out of compliance. We
have been struggling to operate within the 3-acre limitation per the Approval Order DAQE-AN13283006-20. Since the
inspection, we have filed an NOI to update the Approval Order to permit 9 acres of stockpile rather than 3 acres. We are
currently waiting for final approval on the request.
Please let me know if there is anything else the DAQ would like regarding this matter. We intend to cooperate fully.
