HomeMy WebLinkAboutDERR-2024-005256 MEMORANDUM TO: Therron Blatter, PST Branch Manager Division of Environmental Response and Remediation THROUGH: Avery Holyoak, RAC Section, Manager Division of Environmental Response and Remediation FROM: Mark Crim, RAC Section, Project Manager Division of Environmental Response and Remediation DATE: March 16, 2023 SUBJECT: Transfer of all hard copy information to a closed PST case file Suspected Release at Payson Diesel, located at 838 North Main Street, Payson, Utah Facility Identification No. 1000501, Release Site OGR I have reviewed the file for the suspected release at Payson Diesel, including information obtained by the Division of Environmental Response and Remediation (DERR). My recommendation for no further action at Payson Diesel, release ‘OGR’ is based on information contained in its case file. I recommend that no Reporting and Remediation compliance schedule(s) be sent to the responsible party, no Leaking Petroleum Storage Tank (LPST) file be maintained other than the UST database LUST module file, and that all information be filed in a closed PST case file. This recommendation for closeout is based on a report that an aboveground, waste-oil/heating-oil tank experienced a spill event due to the actions of an employee at the site. The report was called into the DERR by a person wishing to be anonymous. File information justifying no further action includes the following: On January 3, 2023, an anonymous caller reported a waste-oil spill that was alleged to have released 100 gallons of waste-oil onto soil, due to a valve damaged by an employee. The caller indicated the spill occurred more than one-year ago, and that the spill was simply covered with soil. On March 15, 2023, following a previous attempt to reach the owner, the DERR contacted the site owner and discussed the reported spill. The owner said that the anonymous caller was probably a terminated employee, and that representatives of the Utah Division of Waste Management and Radiation Control (DWMRC) had inspected his site in January. The DERR contacted project manager, Leo Calcagno, DWMRC, and obtained information about the Payson Diesel inspection that occurred on January 23, 2023. Inspection notes by the DWMRC indicate that the reported spill was not observed, and that several issues relating to waste-oil container labeling were addressed at that time. Because there is no evidence of the reported spill, no further action (NFA) is recommended.
