Upon review of the records, the Division determined that the claim of business confidentiality made by Sunroc Corporation meets the requirements of Utah Code Section 63G-2-309 and the standards of the federal Freedom of Information Act (FOIA), 5 U.S.C. Section 552, which standards apply to the records under Utah Code Section 19-1-306(2). As a result, the Division will manage the records in accordance with Utah Code Section 63G-2-305. Future consideration of record disclosure is also subject to Utah Code Section 63G-2-309(1)(b) and (2). You also requested “that all proceeding financial statement be hidden from the past.” This language appears to be an attempt to claim CBI for all financial statements that Sunroc Corporation may have submitted to the Division in the past. This type of claim is not allowed, and this has been communicated to Sunroc Corporation in a letter to Bill King dated August 8, 2022, and in a letter to Ryan J. Meyer dated May 14, 2024. Sunroc Corporation must identify the specific records that it would like protected and make the claim for each of those records. Keep in mind that the Division has no responsibility for any copies of records that may exist outside the control of the Division for which a proper classification of public was made at the time the records were submitted to the Division. This letter involves an agency action. If you disagree with the agency determination described in the first paragraph above, you may appeal the agency determination within 30 days of the date of this letter by filing a notice of appeal, in accordance with Utah Code Section 63G-2-401, to the following chief administrative officer for the Division: Douglas J.
