RE: The 2022 Annual Tailings System Wastewater Monitoring Event, Closeout Letter,
Groundwater Quality Discharge Permit Number UGW370004.

Dear Ms. Weinel:

On August 24, 2022, the Utah Division of Waste Management and Radiation Control (Division)
completed the field inspection of the 2022 Annual Tailings System Wastewater Monitoring Event by
Energy Fuels Resources (USA) Inc. (EFRI). This inspection also included the collection of a
split-sample by the Division of tailings wastewater in the Tailings Cell 1.

The inspection was based on compliance with the:

1. White Mesa Uranium Mill Ground Water Quality Assurance Plan (“QAP”). Revision 7.4,
dated July 23, 2018.

2. Groundwater Discharge Permit No. UGW370004 (“Permit”), dated March 19, 2019.

3. Tailings and slimes Drain Sampling Program (“Sampling Plan”) Revision 3.0 dated July 8, 2016.

The findings of this inspection and results of the analytical analysis for the Division split sample of the
wastewater in Tailings Cell 1 will also be included as part of the review to complete the inspection for
the Annual Tailings System Wastewater Monitoring Report due December 1, 2022.

Based on Division staff observation of EFRI staff performing the sampling and monitoring on
August 24, 2022 it appears that the staff is in compliance with field sampling requirements in the Permit,
QAP and Sampling Plan. This letter constitutes a closeout of the August 24, 2022, Annual Tailings
System Wastewater Monitoring Event
