Dear Mr. Mensinger and Mr. Zody:

The U.S. Environmental Protection Agency is issuing the enclosed Notice of Violation (NOV) to US
Magnesium, LLC (US Mag) for alleged violations arising under the Clean Air Act (the Act) Section
112(d), 42 U.S.C. § 112(d), and its implementing regulations for the National Emission Standards for
Hazardous Air Pollutants, at 40 C.F.R. Part 63, subpart TTTTT. Violations of the Act and the
regulations, at US Mag’s Rowley plant, are alleged with specificity in the NOV.

This NOV provides US Mag with an opportunity to schedule a meeting to discuss these alleged
violations. Please have counsel contact Max Greenblum, at [phone] or
[e-mail], within 30 days of receipt of this NOV, if US Mag would like to schedule a
meeting.
