RIO ALGOM MINING LLC-LISBON OPERATION
Semiannual Groundwater Monitoring Report
2nd Half 2009

Introduction:

This report meets the requirements of DRC License # UT 1900481, Condition 53
and presents the monitoring results of the groundwater sampling required by the
Long Term Surveillance Monitoring Plan (LTSM) as required by Condition 53 of
the License. This report contains the following elements:

A discussion and interpretation of the groundwater sampling results and
concentration trends, Uranium Compliance limits or Uranium Target Action
levels as stated in table 1, license condition 53 B.

Appendix 1 contains analytical data for the monitoring wells.

Appendix 2 presents the time versus concentration plots for required
parameters

Appendix 3 contains the depth to water over time for the wells.

Appendix 4 contains the hydrographs for the wells.

Appendix 5 presents the field data sheets including the field parameter
measurements.

Appendix 6 presents copies of the laboratory analytical reports for the 2nd
half of 2009.

Appendix 7 presents the groundwater contour maps.

Appendix 8 contains the sampling methodologies used to conduct the
sampling.

Discussion

The data provided in this report represent sampling results from the 2nd half of
2009.

The required monitoring wells are listed below:

Reviewing the results from the current sampling event for POC well OWUT-9,
none of the concentrations for the COCs were exceeded, as demonstrated below.

In granting ACLs for the Lisbon Site the USNRC maintained the Background
groundwater concentrations at the same level established in 1990 and they are as
follows:

Reviewing the results from the current sampling events for POC background wells
MW-13 and MW-5, the following concentrations were noted.

All of the above reported concentrations, with the exception of Se in MW-5, are
below the background concentrations. Review of the trending of the selenium
concentration in this well shows a steady concentration of approximately 0.06
mg/l since February 2002. The last report, 1st Half of 2009, stated the past 14
years, this should have been the last 14semi-annual reporting periods. This level
does not exceed the class III water standard for this aquifer. The arsenic in MW-
13 is trending higher, but at 0.027 mg/l it is not approaching the background
concentration of 0.066 mg/l.

Wells RL-4, RL-5, and RL-6, located on the northern LTSM boundary, are used
for monitoring Point of Exposure (POE) concentrations. The constituent of
concern (COC) for the above POE wells, as stated in Table 2 of license condition
53 B, is U-Nat and the Uranium Compliance Limit is 0.32 mg/L. Table 7 presents

the observed U-Nat concentration the second half of 2009, verses the Uranium
Compliance Limit. All of the POE wells are well below the 0.32 mg/l health based
standard.

Trend wells EF-6, EF- 8, ML-1, RL-1, RL-3, H-63 and LW-1, located throughout
the area to be transferred to the Department of Energy, are used for validation of
the transport model prediction and trends. The constituent of concern for these
wells is U-Nat as stated in Table 3 of license condition 53 B. The following table
shows the comparison of the concentration found in these trend wells with the
Uranium Target Action Levels. All uranium concentrations within these wells were
below the target action level established within the license. The results for
Monitor Well RL-1 are an average of four sample analyses. In August of 2009 the
DRC approved RAM’s proposed Uranium Target Action Level of 0.028 mg/L for
Monitor Well LW-1. The reported result of 0.0023 is well below the Action Level.
The molybdenum concentration in RL-1 is trending higher; however, not Target
Action level was set for the well. The original Mo value was 8.02 mg/l in March
2003; the value has increased to 11.1 during the most recent sampling event.

Review of the water level elevations in the monitoring wells showed that RL-6 has
a slightly downward trend while most wells indicate no trend. The EF wells (3A, 6,
and 8) show a slight upward trend in water elevation.

Field sampling observations showed that there were frequent air bubbles in the
multi-probe flow cell unit used to obtain the stability parameters prior to sampling
the water from the wells. In an effort to reduce the bubbles, noted particularly in
the ORP cell (oxidation/reduction potential), the locking nut holding the cell was
over-tightened and resulted in cracking the glass probe. For this reason the ORP
values should not be considered reliable during this sampling event.

The August sampling event included having the sampling procedure monitored by
a staff member of the Utah Department of Radiation Control. Potential residual
soap solution from the cleaning and rinsing step conducted between collecting the
different well samples, positioning of the bladder pump in the correct down-hole
location, and the air bubbles in the flow cell unit were concerns noted by the DRC
staff member. These issues were reviewed by Rio Algom Mining LLC and their
consultant. Rio Algom Mining will make final sampling adjustments based on
results obtained from their consultant and final instructions provided by the DRC.
