Dear Mr. Rnerfrock, Ttiis letter is in reply to your letter addressed to Billy Ray, Project Engineer, dated February 16, 2010, in which you advised of tv^o options for Rio Algom Mining LLC in relation to the Bureau of Land Management's possible approval of the installation of v/ater supply well(s) south of the LTSM boundary. You advised that "additional modeling simulations and/or construction of monitoring wells along the southern border of the LTSM may be required in the future, depending on the final well location selected." In addition, Mr. Tom Rushing, PG, with the Division of Radiation Control, sent an e-mail also doted February 16, 2010, that presented another option for Rio Algom Mining to consider. This option was to utilize two existing monitor wells as compliance wells, and would require development of compliance limits for background well MW-13 and trend well H-63. A copy of Mr. Rushing's email has been attached with this letter. Rio Algom Mining appreciates being kept apprised of activity in the area and fully intends to continue to satisfy and fully cooperate regarding all of its obligations.
