September 3, 2009 T' Semi Annual Ground Water Stability Moniioring Repon, \'' Half 2009, Received by DRC September 9, 2009, Radioactive Materials License No. 1900481: DRC Closeout and Discussion 2009 j" Semi Annual Ground Water StabiUty Report Closeout DRC has reviewed the document titled "Rio Algom Mining LLC Lisbon Facility, Radioactive Materials License UT1900481 (RML), Semi Annual Groundwater Stability Monitoring Report, 1^' Half 2009". dated September 3, 2009 and received by DRC on September 9, 2009. Per review, the report appears to comply with the RML Condiiion 53 (Ground Water Compliance Monitoring Program), therefore this matter is closed. Di: sen ss ion Despite the above finding, and as you are already awaie, there are a number of issues and concems raised by DRC m an August 26. 2009 "Request for Information (RFIJ" letter. We received your request for an extension to respond (dated September 30, 2009), and your November 4, 2009 response to the RFI. Both the RFI and Rio .A.lgom responses were regarding the August 5, 2008 and August 11, 2009 split sampling events between DRC and Rio Algom. Your response is currently under review by DRC. Please be advised that it is DRC's intention to modify lhe facility Radioactive Materials License to include requirements for Quality Assurance Procedures, including field sampling and dala validation in the near future as stated in the DRC August 2009 RFI letter (License Modification 4). You will receive correspondence and an updated red-line copy ofthis draft License modification in the near future. Please note that these items will be addressed in separate License modifications.
