Dear Duc and Tom:
This letter constitutes Kennecott Utah Copper LLC's (Kennecott) annual reporting under the Access
Control Construction and Maintenance Work Plan (Work Plan) dated May 2009 that is appended to the
Settlement Agreement and Administrative Order on Consent (AOC) in the above referenced matter.
Pursuant to the Work Plan, Kennecott is required to:
1) lnspect the perimeter fence, gates, and signage twice each year. lnspecttons will verify that
fencing, gates, and signage remain intact; inspectors will also make observations regarding
possible unauthorized access of the fenced-in property, and matntain a record of such
inspectrons in its project files; and
2) During semi-annual inspections make observations of possible recent sediment run-on or run-of,
and also conduct unscheduled inspections on becoming aware of any severe thundershower
activity in the Stockton area.
Kennecott conducted inspections of the Northeast Stockton Parcel twice during 2024. lnspections took
place on May 16, 2024, and on October 3, 2024. Documentation of these inspections will be retained
electronically in Kennecott's files Below is a summary of the inspection ftndings
May 16, 2024
Minor damage to fencing (loose or broken wire) was found in 3 to 4 locations and was subsequently
repaired. Fencing othenrrise appeared to be in good general condttion. Srgnage was found in good
condition. There were no observed tssues with any gates or locks and no indications of trespassing or

unauthorized use. There were no indications of recent erosion and sorls on the site appeared to be stable
with well-established vegetation.
October 3, 2024
Minor fence damage was found on the northwest side of the property and was scheduled to be reparred.
All other fencing appeared to be in good general condition. No issues with gates or locks were observed
and no indtcations of unauthorized use were evident. All signage was in good shape. There were no
indications of notable sorl run off or run on.
