RE: Big West Oil Tank 31 NSPS Subpart Kc Applicability Determination
Mr. Bird,
In a refill notification for Tank 3l dated March 22,2024, Big West Oil LLC (BWO) indicated
that the storage vessel will be subject to the NSPS Subpart Kc rule according to the proposed
rule applicability requirements and that another applicability assessment would be performed
after the final rule was codified.
After evaluation of the rule finalized on October 15,2024, it has been determined that Tank 3l is
not subject to NSPS Subpart Kc. 40 CFR $60.1l0c(b)(8) states that the subpart does not apply to
"Vessels that only store VOL with a maximum true vapor pressure less than 0.25 psia (l.7kPa
absolute)." The VOL stored in the tank is a diesel blend stock with a maximum TVP below the
de minimus threshold, therefore, Tank 31 is exempt from NSPS Subpart Kc.
