RE:Temporary Compliance Extensions to Unloading Requirements at Clean Harbors AragoniteUTD981552177
Dear Mr. Simmons:
On October 4, 2024, Clean Harbors Aragonite (CHA) submitted a written request to continue their compliance extension for the 10-day trailer unloading requirement in Section 3.D.9. of
the Permit and 15-day bulk container unloading requirement in Section 4.D.20. of the Permit. CHA originally requested the extension due to the annual maintenance outage atCHA.In this
request, CHA indicated they have added additional receiving crew to assist in trailer offloading and have developed an offload schedule for all bulk containers which projects compliance
by the end of October. Additionally, CHA indicated the finalization of an additional incinerator at the Clean Harbors facility in Kimball, Nebraska, which is projected to be online by
early 2025, will assist CHA remain in compliance. CHA indicated that construction of a 10-day transfer facility adjacent to the CHA facility will also assist CHA remain in compliance.
The compliance extension for the trailer unloading and bulk container unloading requirements is hereby approved until December 31, 2024. Until the extension ends, CHA will continue
tosend a weekly report to the Division that includes:
A list of all trailers over the 10-day requirement and all bulk containers over the 15-day requirement;
A list of trailers unloaded and bulk waste containers processed during the week; and
An updated plan for processing the remaining waste. If the number of trailers or bulk containers over the unloading requirements increases from the previous week, please include a description
of where that waste came from and how it will be processed.
