HomeMy WebLinkAboutDSHW-2024-006127 NOTICE On May 19, 2023, Clean Harbors Aragonite (Aragonite) submitted a Class 2 permit modification request to the Division of Waste Management and Radiation Control (Division) seeking approval to make changes to the permit in how the incineration chemistry is determined for certain waste types. Specifically, Aragonite requested the Waste Analysis Plan be modified to allow consolidation containers from DOT hazard classes 2.2 and 4.2 and lab packs from DOT hazard classes 4.2 and 4.3 to use incineration chemistry matrixes created from summary analytical data submitted with the modification request. Aragonite also requested the ability to develop incineration chemistry matrixes, organized by DOT hazard class, for routine wastes received at the facility in containers equal to or less than five gallons in volume. On May 30, 2023, Aragonite submitted a Class 2 permit modification request seeking approval to construct and operate an additional drum pumping station and add the ability to store containers of waste in the building E-4 decant area. As part of the Class 2 permit modification process, a 60-day public comment period and an informational public meeting were held in connection with both modification requests. No public comments were received. Following review of the modification request to add an additional drum pumping station and additional storage in building E-4 decant area, the Division authorized construction of the new drum pumping station on August 31, 2023. Following review of the construction certification, the Class 2 modification to add an additional container pumping station and additional container storage in building E-4 decant area was approved on April 30, 2024. Part of the changes to the permit included an increase in Aragonite’s closure cost estimate due to the increase in container storage capacity at the facility. The closure cost estimate increased by $53,481 with a new total facility closure cost estimate of $20,228,969. Aragonite has 60 days from the date of approval of the modification to increase the facility’s financial assurance closure mechanism and cover this increased cost. Following review of the modification request to modify how the incineration chemistry is determined for certain types of wastes, the modification was approved on April 22, 2024. I understand mailing list is in Sales Force and the appropriate units of State and local government are just Tooele County (both the Health Department and the regular Tooele County), Division of Air Quality, Division of Water Quality, State Fire Marshall, and the Utah Labor Commission. Those other entities on your notification list are only necessary for other certain notices, like when we issue/reissue permits, but they aren’t required when we are just sending the notice to the facility mailing list and appropriate units of State and local government as in this case.
