Everett Director ERRL-0085-24 February 29, 2024 Sean Julian Julian’s Quality Convenience, LLC 141 West Brigham Road St. George, Utah 84790 Re: Approval for Work Plan and Budget No. MSM-15 Petroleum Storage Tank Fund Bloomington Market, located at 141 West Brigham Road, St. George, Utah Facility Identification No.6000342, Release Site MSM Dear Mr. Julian: The Division of Environmental Response and Remediation (DERR) received the Work Plan and Budget (WP&B) and Work Plan Approval Application and Agreement on January 12, 2024. The WP&B dated January 12, 2024 was prepared by Atlas Technical Consultants, Inc. This WP&B is for Corrective Action Plan (CAP) public comment and implementation of a free product removal system. The CAP is in general compliance with Utah Admin. Code R311-211 and R311-202. The DERR makes no guarantee, implied or otherwise, that the approved CAP will be successful in obtaining established cleanup levels. In the event that the cleanup goals are not met by the CAP, further work at the facility may be required prior to site closure consideration. The DERR approves the WP&B up to $346,832.75. This approval is contingent that the costs being submitted for reimbursement meet the requirements of the rule changes that became effective on September 13, 2021, including the incorporation of the Cost Guidelines for Utah Underground Storage Tank Sites document. Please submit documentation of your Public Notice by March 29, 2024. This step must be properly completed before system installation activities begin. Requests for Reimbursement must be submitted in accordance with Utah Petroleum Storage Tank (PST) Rule R311-207-4. Please reference WP&B No. MSM-15 on your Request for Reimbursement. Payment for work conducted under this WP&B will be for actual time and materials expended up to, but not exceeding, the amount of the approved line item budget. Payment shall be limited to documented costs that are customary, reasonable, legitimate, and directly related to the work tasks performed. Requests for payment must be received by the DERR within one year of the Facility ID# 6000342 Page 2 date that the work was performed or reimbursement shall be denied in accordance with Utah PST Rule R311-207-3(8).
