The Border Store, located at 625 North State Street, Hildale, Utah
Facility Identification No. 6001029, Release Site OIM
Dear Mr. Dockstader:
On August 6, 2023, a petroleum release from a petroleum storage tank (PST) was reported
to the Division of Environmental Response and Remediation (DERR) based on Incident Report
Number 16550. On October 2, 2023, a Subsurface Investigation Reporting and Remediation
Compliance Schedule (Compliance Schedule) was sent to you which outlines information required
to be submitted to the State of Utah concerning your above-referenced Release Site. To date, the
required information has not been submitted and is currently past due.
Pursuant to Utah Admin. Code R311-202, Sections 280.62 through 280.65, The Border
Store is required to perform initial abatement measures, characterize the site by determining the
extent, degree, and location of petroleum contaminated soils and the presence, concentration, and
extent of dissolved petroleum contamination in the groundwater, and initiate free product removal,
when appropriate. The report(s) associated with these requirements was outlined in the Compliance
Schedule and was due on December 31, 2023.
If the results of your overdue report indicate that laboratory analytical results are above
State-established cleanup levels, or the extent and degree of the subsurface contamination is not
adequately defined, you will receive and be required to comply with the requirements of additional
Compliance Schedule(s). In addition, you may be required to conduct remediation (cleanup) of any
subsurface contamination which does exceed applicable State-established cleanup levels.

After December 31, 1995, any PST release management, abatement, investigation or
corrective action must be performed by a Certified PST Consultant as outlined in Utah Admin. Code
R311-201-2. Failure to submit the required report(s) referenced herein within 60 days of your
receipt of this notice may result in further compliance actions against you.
