The file for this release has been reviewed by the Division of Environmental Response and
Remediation (DERR) project manager who has recommended that no further corrective action be
taken at this time. This no further action applies only to the specific Release Site OJR. This
recommendation is based on information contained in the file for the release. That information was
supplied by you, your consultant, or another representative.
The information submitted indicates that petroleum contamination of the soil remains from
this release. The contamination is at depths and locations that are not currently considered a threat
to human health or the environment according to Utah Admin. Code R311-2 l 1. This evaluation is
based on current land usage, exposure pathways, potential receptors and other site-specific risk
characteristics. In the future, if changes to these characteristics create a threat to human health or
the environment, additional corrective action may be required.
Due to the nature and location of contamination that has been left in-place, the DERR is
utilizing Blue Stakes of Utah to receive notification when excavators may be digging within the
contaminated area. The DERR will provide the attached flyer to excavators when notification is
received from Blue Stakes.

1.Through the Blue Stakes Utility notification system, the Utah Division of Environmental
Response and Remediation (DERR) received information that you plan to excavate in the
vicinity of the above referenced property.
2.The map below shows a “Restricted Area” at this property where petroleum
contamination is known to exist and land use limitations/restrictions are in-place.
3.If excavation or dewatering is proposed within or immediately adjacent to the area in the
red, as seen below, contact the DERR at (801) 536-4100, and refer to this Notice.

A release of petroleum was reported to the Division of Environmental Response and Remediation
on January 5, 2024. The extent and degree of contamination has been fully defined and a No Further
Action (NFA) review is hereby requested.
Case file information justifying no further action includes the following:
The site of this release has recently been sold and as part of that transaction, a Phase II Limited
Subsurface Investigation was conducted which discovered impacts to the soil and groundwater. The
property had one 12,000 gallon AST that was not regulated by the DERR however, the purchaser of
the property asked for DERR oversite in the remediation and the issuance of an NFA once the site
was eligible for closure.
