Box 1068 Duchesne, UT 84021 RE:DWMRC Response to Limited Site InvestigationReportand Cover Letter [DSHW-2024-004771] Dear Mr. Robinson: On February 21, 2024 the Utah Division of Waste Management and Radiation Control (Division) received a copy of the Limited Site Investigation (LSI)Reportwith Cover Letter (DSHW-2024-004771). For purposes of this letter, the LSI Report and Cover Letter portions of the document will be referred to individually as such. The LSI Report was prepared by Terracon Consultants Inc. for Integrated Water Management LLC (IWM) and the Cover Letter was prepared by IWM and signed by you. TheReport provides an assessmentof concentrations of regulated constituents typically associated with oilfield exploration and production (E&P) waste at IWM’s facility, located at 20250 West 2000 South, Duchesne, Utah.The contents of the Cover Letter, among other things, discusses the following: Presents concerns about E&P waste cell design standards; Requestsa list of Utah solid waste facilities with “natural lined landfill cells” andsubsequent approval dates; and Presumes that issuing a temporary permit for and unlined E&P waste facility would violate both U.S. and Utah environmental laws. In response to your question “how it is possible in Duchesne County to dump huge amounts of drilling mud on unlined ground?” The waste in question is exempt from hazardous waste management regulations, according to Utah Admin. Code R315-261-4(b)(5) and 40 CFR 261.4(b)(5). Further, it is allowed for disposal into unlined Class IIIb landfill cells according to Utah Admin. Code R315-304-3(2). Lined landfill cells are only required by federal regulations when the landfill accepts MSW or CCR waste (see 40 CFR Parts 257 and 258). In response to your request for a list of Utah solid waste facilities with “natural lined landfill cells” and subsequent approval dates. A list of Utah facilities, approval dates, and landfill classificationshas been generated for all Class II MSW landfills, Class III Industrial landfills, and Class IV and Class VI CD landfills (Table 1). According to the Utah Administrative Rules these landfill classifications do not necessarily require cell liners, depending on the circumstance. In addition, both State and Federal regulations allow for unlined Class I landfills under certain circumstances. The Division does not keep a specific list of Class I, Class II, Class III, Class IV, and Class VI landfills that have received approval for a liner alternative under Utah Admin. Code R315-303-3(3)(c). If that information is desired, please submit a GRAMA request that details the information that you are interested in, and the Division will provide you with an estimate of the cost to conduct a permit search to provide you with the information. In response to the presumption that issuing a temporary permit for and unlined E&P waste facility would violate both U.S. and Utah environmental laws. The report that you have provided appears to identify some of the constituents found in oil and gas exploration and production wastes. These wastes are exempt from the hazardous waste management requirements of the Utah Solid and Hazardous Waste Act, the Utah Administrative Rules adopted under that Act, and the requirements of the U.S. Resource Conservation and Recovery Act. As provided in the responses above, the Division is not aware of any conflicts between these State regulations and the Federal regulations for the management of oil and gas E&P waste. If you are concerned that the Federal regulations are not protective enough for Utah’s environment and citizens, we invite you to contact your local legislative representative to share your concerns.
