Dear Andrew Beecher: On December 10, 2024, the Division of Drinking Water (the Division) received your request for an exception to Rule R309-540-8(2) regarding the number of pumps required for the hydropneumatic facility. According to this rule, a public water system using a hydropneumatic facility to meet the minimum distribution system pressure requirements of Section R309-105-9 shall have at least two pumps installed and in operation at the hydropneumatic facility, unless the hydropneumatic facility is supplied solely by a well pump. The basis for your request for an exception to R309-540-8(2) is that your system is a transient, non-community water system that serves only campers for approximately four months each summer. In the event the single pump supplying the hydropneumatic tank failed and needed to be replaced or repaired, you propose that you would postpone or cancel camp events until the issues were resolved or temporarily bring in bottled water, which provides equivalent protection for public health to meet the intent of the rule. On this basis, an exception R09-540-8(2), Number of Pumps, is hereby granted for the Hydropneumatic Facility Pump (PF001). This Temporary Exception expires onDecember 31, 2027. You must inspect and maintain the hydropneumatic facility on a regular basis. You will be required to re-submit an exception request along with confirmation that all conditions outlined in this temporary exception have been fulfilled and obtain an exception renewal prior to December 31, 2027. Exceptions granted by the Division include an expiration date to ensure that the basis and conditions for granting the exception are verified periodically and that the drinking water quality remains protected. After receiving your request, the Division will determine whether this exception can be re-issued. Failure to request the re-evaluation of this exception and obtain an exception renewal by December 31, 2027, will result in the activation of the deficiency related to not having a redundant pump. This Temporary Exception may be rescinded any time if new evidence indicates that the conditions of this exception are no longer being met or a public health risk exists due to this exception.The issuance of this exception temporarily resolves your water system’s deficiency related to lacking a redundant pump for the hydropneumatic facility (PS18) as required by R309-550-8(2).
