This Temporary Exception Expires on December 31, 2027.
Dear Jake Ferguson:
On November 28, 2024, the Division of Drinking Water (the Division) received your request for an exception to Rule R309-515-6(6)(b)(vi), R309-515-6(12)(c)(ii), and R309-515-6(13)(a),
Well casing terminating 18-inches above the ground surface for the Val Vista Well 3 (WS007).
The Division’s understanding is that the Val Vista Well 3 (WS007) casing current extends about 8 inches above the ground surface. A deficiency for this was assigned during the 2024 Sanitary
Survey for the South Davis Water District. In order to address this violation, the South Davis Water District would need to excavate the concrete pad around the casing in order to meet
the 18 inches of clearance above the ground surface. This would then cause an area where water could collect and cause issues with the well.
The basis for your request for an exception to R309-515-6(6)(b)(vi), R309-515-6(12)(c)(ii), and R309-515-6(13)(a) is that the Val Vista Well 3 (WS007) is located on a slope where it
is highly unlikely that flood waters would rise above the top of the well casing. You propose that this meets the intent of the rule to prevent external water from entering the well
and provides equivalent protection of public health.
On this basis, exceptions to R309-515-6(6)(b)(vi), R309-515-6(12)(c)(ii), and R309-515-6(13)(a), Well casing terminating 18-inches above the ground surface, is hereby granted for for
the Val Vista Well 3 (WS007).
This Temporary Exception expires on December 31, 2027.
You will be required to re-submit an exception request along with confirmation that all conditions outlined in this temporary exception have been fulfilled and obtain an exception renewal
prior to December 31, 2027.
Exceptions granted by the Division include an expiration date to ensure that the basis and conditions for granting the exception are verified periodically and that the drinking water
quality remains protected. After receiving your request, the Division will determine whether this exception can be re-issued.
Failure to request the re-evaluation of this exception and obtain an exception renewal by December 31, 2027, will result in the activation of the deficiency related to the Val Vista
Well 3 (WS007) casing terminating less than 18 inches above the ground surface.
This Temporary Exception may be rescinded any time if new evidence indicates that the conditions of this exception are no longer being met or a public health risk exists due to this
exception.The issuance of this exception temporarily resolves your water system’s deficiency of S003 related to the Val Vista Well 3 (WS007) well casing terminating less than 18-inches
