The Utah Underground Storage Tank (UST) Act provides that the Executive Secretary (UST) may revoke a Certificate of Compliance if it is determined that a facility is not in substantial compliance with all state and federal UST statutes, rules and regulations. At the request of the Executive Secretary (UST), the Division of Environmental Response and Remediation (DERR) performed a compliance review for the underground storage tanks at the above facility. The compliance review, performed on April 19,2005, indicates you have not satisfied the requirements of the Act and are out of compliance. To achieve compliance you must do the following: l. Kar Kwik, [nc. owns or operates four (4) Underground Storage Tanks (USTs) at the facility which are regulated under Subtitle t of the Resource Conservation and Recovery Act, 42 U.S.C. 56991c, et seq. The tanks are not closed. 3. Kar Kwik, [nc. has failed to pay fees for the fiscal year 1988, July 7, 1987 to June 30, 1988, of $25.00 per tank as required by 26-l4e-3O2 of the Utah Code furnotated, 1953, as amended. Accordingly, Kar Kwik is required to come into compliance with 26-14e-302, Utah Code Annotated, 1953, as amended; by payrng the fee assessment for fiscal year 1988 which totals one hundred dollars ($100.00).
