Mini Mart #7 located at7l0 S Washington Ave, Ogden, Utah;
Mini Mart #8 located at 1015 E. l2th St, Ogden, Utah
Facility Identification No. 12001 12 and 1200334.
The Utah Underground Storage Tank (UST) Act provides that the Executive Secretary (UST) may
revoke a Certificate of Compliance if it is determined that a facility is not in substantial compliance
with all state and federal UST statutes, rules and regulations.
At the request of the Executive Secretary (UST), the Division of Environmental Response and
Remediation (DERR) performed a compliance review for the underground storage tanks at the above
facility. The compliance review, performed on April 19,2005, indicates you have not satisfied the
requirements of the Act and are out of compliance. To achieve compliance you must do the
following:

Submit documentation to show that you have had a qualified cathodic protection tester test
your cathodic protection system within the last three years. Due to 2004 UST rule changes all
cathodic testing must be performed by a State of Utah certified tester utilizing DERR
approved testing criteria.

The inspection performed on 6-24-02 , indicates that you have not satisfied the State Rules
and Regulations for underground storage tanks. To achieve compliance you must do the
following:
1. Submit a copy of a line tightness test for all product lines.
(Lines need to be tested every year)
2. Submit a copy of a function test on all automatic line leak detectors.
(Leak detectors need to be tested every year)
3. Submit documentation that the Automatic Tank Gauging (ATG) system performed a
monthly leak test for TIIE PAST YEAR
(ATG should go into test mode once a month)
4. Submit a copy of you Corrosion Tests for your USTs.
(Last test was conducted in 1998) Test should be conducted every 3 years.
Submit the above required information to this office by 15 SEP 2002 . If it is not received by
this date we will start the process to revoke your Certificate of Compliance.

Dear Kent,
precision tests were performed on four (4) underground storage.tanks at the
above location from September 26, 1990 through October 25, 1990 using the Tracer
Tight " method for tank tightness testing. We have reviewed the data produced in
co-njunction with this test for purposes oiverifying the results and certifying the tank
,y.i"r. The testing was performed in accord-ance with Tracer Tight* protocol, which
meets the criteria set forth in NFPA 329 for a precision tank test.
The results of tank testing indicate that the tanks are in compliance with the
EPA criteria of less than .05 gallons per hour.

Dear Mr. Wangsgard:
Based on evidence in record you have violated Section 26-74e-3O2, Utah Code
Annotated, 1953, as amended, for non-payment of Underground Storage Tank (UST)
fees. The violation is based on the findings below:
1. Kar Kwik, [nc. owns or operates the facility located at 1215 12th Street,
Ogden, Utah which has been assigned the Facility ldentification Number of
1200334.
2. Kar Kwik, [nc. owns or operates four (4) Underground Storage Tanks
(USTs) at the facility which are regulated under Subtitle t of the Resource
Conservation and Recovery Act, 42 U.S.C. 56991c, et seq. The tanks are not
closed.
3. Kar Kwik, [nc. has failed to pay fees for the fiscal year 1988, July 7, 1987
to June 30, 1988, of $25.00 per tank as required by 26-l4e-3O2 of the Utah
Code furnotated, 1953, as amended.
Accordingly, Kar Kwik is required to come into compliance with 26-14e-302, Utah
Code Annotated, 1953, as amended; by payrng the fee assessment for fiscal year 1988
which totals one hundred dollars ($100.00). Payment is to be received within 14
days of receipt of this NOTICE OF VIOLATION.
