My recommendation for no further action (NFA) at the DW release site ‘OHL’, is based on information in its case file. I recommend that no Reporting and Remediation compliance schedule(s) be sent to the responsible party, no Leaking Petroleum Storage Tank (LPST) file be maintained other than the UST database LUST module file, and that all information be filed in a closed PST case file. This recommendation for closeout is based on a reported aboveground storage tank (AST) diesel overfill event, at a remote cell-tower, near the Bullfrog Marina, Lake Powell, Utah. File information justifying NFA includes the following: On March 9, 2023, an Environmental Incident Report, #16171, came to the DERR regarding a diesel spill at the DW facility. The National Parks Service, Maintenance Supervisor, Peter Drevnick, reported that a cell tower’s emergency generator AST had a diesel spill due to an overfill event. The spill approximated 50 gallons, and impacted an asphalt road and sandy soils. Mr. Drevnick abated the release by excavating the visibly-impacted soils and asphalt, and placing them in a roll-off container for proper disposal. DERR, LUST-RA and PST Compliance sections, exchanged information over several weeks with DW’s contact, Michael Wilson; first to ensure that the spill was sufficiently abated, and second, to determine the AST’s regulated status. By March 27, 2023, the DERR determined that the AST was not regulated, and by April 26, 2023, the DERR was in receipt of a report from a DERR-certified PST Consultant, providing information about abatement actions, soil disposal and soil sampling results. Submitted information indicates the release was abated, impacted-soil was disposed of properly, and soil testing showed no petroleum above the state-established cleanup levels. Because the diesel spill, abatement actions and the report of findings were all associated with a non-regulated AST, NFA is recommended.
