Bird Director December 3,2024 DAQC-I192-24 Site ID 10278 (B1) Sent Via Certified Mail No. 70022030000044115601 Chris Rose Staker & Parson Companies 89 West 13490 South Draper, UT 84020 Dear Mr. Rose: Re: Compliance Advisory - Staker Parson Companies dba Western Rock Products, Approval Order (AO) DAQE-AN 1 02780003-l 9, Iron County On June 4,2024, a representative of the Utah Division of Air Quality (DAQ) conducted an inspection of Staker Parson Companies located at 1405 North Bulldog Road, Cedar City, UtahS4T20.Information provided following the inspection indicates that daily operation start and end times of the aggregate equipment and concrete batch plant were not being reported as required by this AO. The DAQ also received notice that haul roads and loader operation areas exceed limits established by this AO. These observances may be violations of ConditionsI.2,ll.B.2.b, II.B.2.b.l, II.B.3.b, ILB.3.b.1, and II.B.4.a of AO DAQE-AN I 02780003- I 9, dated January 23, 2019. Staker Parson Companies is required to comply with the above regulations. A written response to this letter is required within ten (10) business days of receipt of this letter. (801) 903-3978 ww.deq.ulah.gov Printed on 100% recycled paper DAQC-1t92-24 Page2 Potential Violation(s) On June 4,2024, an inspector from the DAQ observed Staker Parson Companies at 1405 North Bulldog Road, Cedar City, in Iron County, Utah. lnformation provided following the inspection indicates that daily operation start and end times of the aggregate equipment and concrete batch plant were not being reported as required by this AO. The DAQ also received notice that haul roads and loader operation areas exceed limits established by this AO. The total haul road lengths are 4,225.2 feet, while the permitted limit is 1250 ft. The loader ion areas are 821.8 feet. while the permitted limit is 350 ft. AO Conditions/Rules Condition I.2 of AO DAQE-ANI02780003-19 states: The limits set forth in this AO shall not be exceeded without prior approval. Condition II.B.2.b of AO DAQE-ANI02780003-19 states: Aggregate processing and associated operations shall not occur before 6 AM or after 9 PM each day from November I through March 31. Condition II.8.2.b.1 of AO DAQE-ANI02780003-19 states: Hours of operation shall be determined by supervisor monitoring and maintaining of an operations log. The hours of operation shall be kept on a daily basis and shall include the time the aggregate processing plant starts operation and the time the aggregate processing plant ceases operation. Condition II.B.3.b of AO DAQE-ANI02780003-19 states: The concrete batch plant and associated operations shall not occur before 6 AM or after 4 PM from November I through March 31. Condition II.B.3.b.1 of AO DAQE-ANI02780003-19 states: Hours of operation shall be determined by supervisor monitoring and maintaining of an operations 1og. The hours of operation shall be kept on a daily basis and shall include the time the concrete plant starts operation and the time the concrete plant ceases operation. Condition II.B.4.a of AO DAQE-ANI02780003-19 states: The haul roads and loader operation areas shall not exceed the following lengths Total haul roads (paved and unpaved) - 1250 ft, and Loader operation areas - 350 ft. [R307-401-8] DAQC-It92-24 Page 3 The purpose of a Compliance Advisory (CA) is to document observations made by the DAQ. You are responsible for complying with the Utah Air Conservation Rules. There are possible administrative and civil penalties for failing to do so. Section l9-2-ll5 of the Utah Code Annotated provides that violators of the Utah Air Conservation Act and/or any order issued there under may be subject to a civil penalty of up to $10,000 per day for each violation. The written response to this CA will be considered in resolving the deficiencies documented in this letter. It may include information demonstrating compliance with the regulations or a schedule to bring your company back into compliance with the applicable regulations. The DAQ will review your response and this CA may be revised as a result of that review. Failure to respond in writing within ten (10) business days of receipt of this CA will be considered in any subsequent enforcement action and the assessment of penalties. Possible DAQ actions to resolve a CA include: No Further Action Letter, Warning Letter, Early Administrative Settlement with reduced civil penalty, Settlement Agreement with civil penalty, or Notice of Violation and Order to Comply. This CA does not limit or preclude the DAQ from pursuing enforcement options concerning this inspection. Also, this CA does not constitute a bar to enforcement action for conditions that the DAQ did not observe or evaluate, or any other conditions found during future inspections.
