Approval Order (AO) DAQE-AN160570001-22, Sanpete County
On July 17,2024, the Utah Division of Air Quality (DAQ) conducted an inspection of Christensen
Arms at 550 North Cemetery Road, Gunnison, UT. At the time of inspection, the DAQ observed
unapproved equipment not listed on the current AO. As a result of those observations, the DAQ
believes that Christensen Arms was in violation of Condition I.3 of AO DAQE-AN160570001-22
and UAC R307-401. These are repeat violations found during a compliance inspection in2022.
The DAQ previously issued a Compliance Advisory (DAQC-023-23) and Early Settlement
Agreement (DAQC-235 -23) to address this issue. Christensen Arms submitted a Notice of Intent
(NOD on October 23,2024.
Please be aware this letter is a waming and that future instances of noncompliance may be
considered violations of Condition I.3 of AO DAQE-AN160570001-22 andUAC R307-401 and
Christensen Arms may be assessed penalties up to $10,000 per day if found to be in violation of
Utah Air Quality Rules. If this warning is related to a requirement involving submiuing a Notice
of Intent to the Director to update or receive an Approval Order under Utah Administrative Code
R307401-5, the DAQ retains its authority to take subsequent enforcement action if during the
next inspection the DAQ finds the source is still not in compliance with R307-401-5.
