Box 144880 Salt Lake City, UT 84114-4880 Re: Permit Renewal Application for Wayne County Long-Hollow Class II Landfill – Response to Completeness Review Comments Dear Douglas, We appreciate the Division’s review of the permit renewal application for the Wayne County Long-Hollow Class II Landfill. The comments have been reviewed, and the necessary updates and revisions to the application have been made to address the identified deficiencies. To assist you further, we have prepared a detailed response document addressing each of the comments provided in the Division’s letter. The Division's comments are shown in italicized text, while Ensign’s responses are shown in bold. Comments – 1. R315-310-3(1)(b) - Plans and drawings of the facility were not included. Please submit plans and drawings that include current ell locations, cell names, and descriptions, and the current landfill boundary. For example, the plans and drawings should include the location of the dead animal pit, household waste, yard waste, etc.. a. Exhibit 1B General Facilities Map has been created and attached in the exhibits section of the report to address missing facility details. Locations of current cell locations are clearly marked on the exhibit. 2. R315-310-4(2)(b)(iii),(iv) -Please provide the depths to ground water or aquifers and the direction and flow rate of ground water. a. Previous Section 3.4 Groundwater is now Section 4.4 Groundwater, containing expanded details on groundwater direction and flow. Specifically, test pits indicated no groundwater within 15 feet, with regional data suggesting depths exceeding 300 feet. Geological formations in this area significantly limit groundwater movement, which aligns with local flow dynamics and confined aquifer conditions. 3. R315-310-4(2)(a)(i) -The topographic map provided does not include the locations for the gas monitoring points and the borrow and fill areas. Please update the map to include this. a. Refer to the updated map in Exhibit 1A. In alignment with previous permits, gas monitoring has not been required for the Long Hollow Landfill, and we request the same exemption in this renewal application, as the landfill’s conditions and operating characteristics remain unchanged. Gas monitoring points are not shown on this exhibit as they do not exist. 4. R315-310-4(2)(c)(ii) - Section 4.3 of the Permit Application indicates that the anticipated facility life cannot be accurately estimated and is considered to be 10 years for the permit renewal. However, Section 2.3 of the Permit Application indicates each new cell www.ensigneng.com Page 2 is designed to provide approximately 10 years of capacity, similar to the initial cells. Using this information, please recalculate the facility’s life. a. Previous Section 4.3 Facility Life is now Section 5.3 Facility Life. The facility life has been recalculated based on the number of future cells, with each providing approximately 10 years of capacity. Please refer to the updated now Section 5.3 of the permit application for the detailed calculation, which now projects the landfill’s remaining life to be 100 years. 5. R315-302-1(2)(a)(i) - Section 3.6 describes no perennial streams, rivers, or permanent surface waters exist within proximity of the landfill, however, the Custom Soil Resource Report Soil Map shows a stream within the landfill boundary and within 1,000 feet of the “Future Class II Cell” locations. Please provide more detail about the stream such as what controls are being taken place during rainy season to prevent water from impacting landfill cells, and if he stream is seasonal or contains year-round flow. Please review R315-302-1(3) for exemption requirements and provide a request and justification for any proposed. a. Previous Section 3.6 has been updated to 4.6. Section has been updated to reflect the stream shown on the Custom Soil Resource Report Soil Map. This stream is intermittent and only flows during rainy seasons or runoff events. For further details, please refer to the updated Section 3.6. b. We are requesting an exemption from the 1,000-foot requirement under R315-302-1(3) for the intermittent stream located on the northern boundary of the landfill. The stream is classified as seasonal and intermittent, flowing only portions of the year. There are natural topographical barriers, including a 10-15 foot elevation difference and roads, as well as engineered stormwater control measures that prevent surface runoff from impacting the landfill. These factors justify the request, ensuring that there are sufficient protections in place to mitigate any potential risk. 6. R315-302-2(2)(a) - Section 2.3 Schedule of Construction does not adequately address the schedule of construction for the new proposed cells. Please provide more details on when these cells will be constructed as well as a provision stating the Division will be informed prior to the construction of a new cell. a. Section 2.3 has been updated to address the anticipated schedule of construction as well as provide a provision stating the Division will be informed prior to the construction of a new cell. 7. R315-302-2(2)(b) - Section 2.10 Tires, indicates waste tires will be stockpiled until a sufficient amount is accumulated. Please provide information demonstrating the facility will meet the recycling requirements of R315-312-2(3), and will not exceed 1,000 tires unless approved according to R315-314. Section 2.11 Special Waste indicates sludges will be accepted if they contain no free liquids. Please provide how this determination will be made such as using the Paint Filter Liquids Test and the records management process. a. Section 2.10 and 2.11 have been updated to address the comments. 8. R315-302-2(2)(h) - Section 2.8 Household and Commercial Waste indicates wind fences are placed around the working face of the household/ commercial waste cell for littler control, and Section 2.16 Litter Control indicates litter control fencing may be established along the perimeter of the active area. Please elaborate more on litter control measures including a schedule to collect litter in a timely manner as well as provide clarity on the presence or absence of wind fencing. a. Sections have been updated to elaborate on litter control measures and schedule. 9. R315-302-2(2)(l) - Section 2.20 Alternative Waste Handling indicates waste will be www.ensigneng.com Page 3 deposited in the emergency disposal site and covered. Please provide more information on the location of the emergency disposal site, such as another permitted landfill. a. Section 2.20 initially indicated that waste would be deposited in an on-site emergency disposal site. This section has been updated to specify that, during operational interruptions, alternative waste will be transported to and managed at the Hanksville Class II Landfill to maintain continuous operations. 10. R315-302-2(2)(o)- Section 2.21 Training and Safety does not provide information detailing a landfill operations training plan and how the facility will fulfill the Annual Reporting requirement of submitting training records as specified in R315-302- 2(4)(b)(vi). In addition, it is not clear that a training program for the facility employees has been established in the identification of prohibited hazardous waste and prohibited waste containing PCBs. Specific workshops are noted, but the frequency of those workshops is not specified. If applicable, the training forms that will be used to fulfill the Annual Reporting requirements should be submitted. a. The revised Section 2.21 expands on training plans and annual reporting requirements, incorporating a structured landfill operations training program for employees, including prohibited hazardous waste and PCB identification training. 11. R315-302- 2(3)(a)(i)- Please specify the location in which records will be stored. The submitted form does not indicate the units for “Estimated Amounts”. Please clarify the units such as tons, yards, etc. If a conversion factor is used to calculate weights or volumes, the conversion factor should be included in the permit application. a. Section 1.6 has been updated to clarify that all daily operating records will be stored on-site in the landfill’s administrative office. Units for waste amounts on the Record Volume Form (Exhibit #4) will specify either cubic yards or tons, with conversion factors applied as per R315-302-2(4)(c) when scales are not used. 12. R315-302-3(6)(v) - As part of the Post-Closure Plan, please include a description of the planned use of the property. a. The following was added to the bottom of Section 6.1: Following closure, the landfill property is planned to remain as passive open space. This area will not be developed for residential, commercial, or recreational use. Instead, it will serve as a buffer zone, preserving the site’s stability and contributing to local habitat and landscape conservation. Public access will be restricted to ensure the protection of the landfill’s post-closure features and environmental controls. 13. R315-303-3(6) - The design drawings provided were not signed and sealed by a professional engineer registered in the State of Utah. Please provide drawings that meet these requirements.. a. All design drawings have been updated and sealed by a professional engineer. 14. R315-303-4(2)- Please provide details on how the facility will prohibit open burning and scavenging, and ensure trained staff are on site during operating hours. a. The following section has been added to the report: 2.24 PROHIBITION OF OPEN BURNING, SCAVENGING, AND STAFFING REQUIREMENTS The Long Hollow Landfill strictly prohibits open burning and scavenging on-site in compliance with R315-303-4(2)(a) and (d). www.ensigneng.com Page 4 Signage is posted to inform the public and staff of these prohibitions. Trained landfill personnel actively monitor for and enforce compliance during operational hours. To meet the staffing requirements set forth in R315-303-4(2)(f), the landfill ensures that trained staff are present on-site during all open hours. For landfills receiving less than 15,000 tons of waste annually, at least one trained operator is on-site whenever the landfill is open to the public.
