Re: Waming Letter - Maverick Crushing, LLC - Utah Administrative Code (UAC)
R307-401, Approval Order (AO) DAQE-ANI59650002-22, Utah County
On July 17,2024, the Utah Division of Air Quality (DAQ) observed source operations at
Maverick Crushing, LLC - Genola Aggregate Pit. At the time of visit, the DAQ observed an
unpermitted 750 kW generator engine along with additional crushing and screening equipment not
listed on the AO. Maverick Crushing, LLC provided additional information indicating this
equipment was included as part of a Notice of Intent (NOI) submitted to New Source Review
(NSR) on December 19,2023, along with revisions to the NOI on February 27,2024, and
August 5,2024. As a result of those observations and information provided after the visit, the
DAQ believes that Maverick Crushing, LLC was in violation of UAC R307-401 and AO
DAQE-ANrs96s0002-22.
Please be aware this letter is a waming and that future instances of noncompliance may be
considered violations of UAC R307-401 and AO DAQE-AN159650002-22 and Maverick
Crushing, LLC may be assessed penalties up to $10,000 per day if found to be in violation of Utah
Air Quality Rules. If this warning is related to a requirement involving submitting a Notice of
Intent to the Director to update or receive an Approval Order under Utah Administrative Code
R307-401-5, the DAQ retains its authority to take subsequent enforcement action if during the
next inspection the DAQ finds the source is still not in compliance with R307-401-5.
