Shelley Executive Director DIVISION OF DRINKING WATER Nathan Lunstad, Ph.D., P.E. Director November 5, 2024 Austin Hinckley Richmond City Water System PO BOX 9 Richmond, UT 84333 Subject: Notice of Violation – Richmond City Water System – UTAH03018 Austin Hinckley: Our records show this water system is in violation of the State of Utah Public Drinking Water Rules. The Division of Drinking Water (the Division) is missing analytical results for the following analytes and compliance periods in 2023: Compliance Period Start Date Compliance Period End Date Analyte Facility Name Facility Code 07/01/2024 09/30/2024 Nitrate WCDI City Well WS004 07/01/2024 09/30/2024 Radionuclides Cherry Creek Well WS006 Failure to collect these samples is in violation of Utah Administrative Code Rule 309-205. The violations result in the addition of points to this system’s Improvement Priority System (IPS) report for each missing sample and could adversely affect this water system’s rating (see R309-400). A nitrate sample from the WCDI City Well (WS004) and a chain of custody showing proof of fourth quarter radionuclide sampling at the Cherry Creek Well (WS006) has been received and these violations have been resolved. However, in accordance with the public notice requirements given in R309-220-7, the system still must notify all its consumers of this violation within one year after the system learns of the violation. Please reference the enclosed public notice template for guidance. Community water systems must provide notice using one or more of the following methods: • Mail or other direct delivery to each customer receiving a bill and to other service connections to which water is delivered • Through the 2024 Consumer Confidence Report due July 1, 2025. Austin Hinckley Page 2 of 2 November 5, 2024 • Another method reasonably calculated to reach other persons regularly served by the system (house renters, apartment dwellers, university students, nursing home patients, prison inmates etc.). A copy of the notice sent to the system’s consumers must be approved by the Division. Please send a copy of the notice to the Division at ddwreports@utah.gov and dbkruse@utah.gov prior to issuing the notice. Please contact David Kruse at (385) 566-7789 or (dbkruse@utah.gov) if you have any questions or need assistance.
