This Temporary Exception Expires on November 27, 2027.
Dear Ray Solorio:
On November 26, 2024, the Division of Drinking Water (the Division) received your request for an exception to Rule R309-515-7(7)(f), Deep Rooted Vegetation. This rule states the following:
R309-515-7(7)(f) - Within the fenced area all vegetation having deep roots shall be removed by a means not negatively affecting water quality.
Background
The Swinging Bridge Spring (WS001) is located within a designated wilderness area managed by the United States Forest Service (USFS).
No grazing is permitted or allowed. Public access is limited to foot traffic for access to the National Park Service (NPS) property, but all motorized vehicle traffic is restricted.
No source sample data is available for the Swinging Bridge Spring (WS001) in the Division’s database. The distribution bacteriological samples have been collected since 1995 with six
positive total coliform samples. The last positive total coliform sample was collected on January 6, 2009.
Exception Request
The basis for your request for an exception to R309-515-7(7)(f) is based on the location of the Swinging Bridge Spring (WS001) in a designated wilderness area and historical water quality
analytical data results.
On this basis, an exception to R309-515-7(7)(f), Deep Rooted Vegetation, is hereby granted for Swinging Bridge Spring (WS001).
This Temporary Exception expires onNovember 27, 2027.
You will be required to re-submit an exception request along with confirmation that all conditions outlined in this temporary exception have been fulfilled and obtain an exception renewal
prior to November 27, 2027.
Exceptions granted by the Division include an expiration date to ensure that the basis and conditions for granting the exception are verified periodically and that the drinking water
quality remains protected. After receiving your request, the Division will determine whether this exception can be re-issued.
This Temporary Exception may be rescinded any time if new evidence indicates that the conditions of this exception are no longer being met or a public health risk exists due to this
exception.The issuance of this exception temporarily resolves your water system’s deficiency related to SS07. An updated IPS report isavailable at https://waterlink.utah.gov. Please

Please maintain a copy of this letter with your permanent records for future reference.
