Dear Ms. Weinel:

The Division of Waste Management and Radiation Control has received your application to amend Utah Radioactive Material License Number UT 1900647 for additional research and development
activities to evaluate methods to recover and concentrate radium-228. Upon review of the documents, the Division has determined that the claim of business confidentiality made by Energy
Fuels Resources (USA) Inc. (EFRI) meets the requirements of Utah Code Section 63G-2-309. As a result, the Division will manage the records in accordance with Utah Code 63G-2-305. Future
consideration of record disclosure is also subject to Utah Code Section 63G-2-309(1)(b) and (2).

NOTICE OF APPEAL RIGHTS

This letter involves an agency action. If you disagree with the agency determination described above, you may appeal the agency determination within 30 days of the date of this letter
by filing a notice of appeal, in accordance with Utah Code Section 63G-2-401, to the following chief administrative officer for the Division:
