Re: Waming Letter - Millstream Equipment Company, LLC, Utah Administrative Code

On May 13,2024, the Utah Division of Air Quality (DAQ) conducted an inspection of Millstream
Equipment Company, LLC located at 4200 East 1800 South in Heber City, UT. At the time of
inspection, the DAQ observed potentially regulated power generation, screening and crushing
equipment, along with excessive dust from the crushing operation. As a result of those
observations, the DAQ believes that Millstream Equipment Company,LLC was in violation of
R307-401 and R307-205. Pictures provided on July 22,2024, indicate that water spray bars were
installed on the crushing operation and operate as needed to mitigate dust. A small source
exemption was issued on October 3,2024 (DAQE-EN16234000I-24).
Please be aware this letter is a warning and that future instances of noncompliance may be
considered violations of R307-401 and R307-205 and Millstream Equipment Company, LLC may
be assessed penalties up to $10,000 per day if found to be in violation of Utah Air Quality Rules.
If this warning is related to a requirement involving submitting a Notice of Intent to the Director
to update or receive an Approval Order under Utah Administrative Code R307-401-5, the DAQ
retains its authority to take subsequent enforcement action if during the next inspection the DAQ
finds the source is still not in compliance with R307-401-5.
