Dear Max Covey:The Division of Drinking Water (the Division) received a project notification form, along with plans and specification and a request for an Operating Permit for the Mayflower
Tank #1 from your consultant, Steve Jackson, P.E. on October 17, 2024. It is our understanding that this facility was constructed without receiving the required Plan Approval by the
Division.
Our understanding of the project is the construction of a 1.2-million-gallon concrete storage tank to serve the village core area of Mayflower Resort. The fire suppression requirement
for this area is 4,000 gallons per minute for 4 hours (960,000 gallons). The tank is filled through a flow control valve that pulls from the Lower East Park Tank (ST005). The tank is
identified as Mayflower Tank #1, ST019, in the Division’s database.
We have received the following information for Mayflower Tank #1 (ST019):
Certification of Rule Conformance with plan approval conditions by a professional engineer.
Hydraulic Modeling Certification signed by Steve Jackson, P.E. with Jackson Engineering.
As-built or record drawings.
Satisfactory bacteriological results as evidence of proper disinfection and flushing.
Evidence of O&M manual delivery.
Construction photos submitted on October 23 and November 18, 2024.
We have determined that all conditions for plan approval and operating permit issuance have been met. On this basis, an After-the-Fact Plan Approval andOperating Permit for Mayflower
Tank #1 (ST019)is hereby issued as constituted by this letter. You may now place the storage tank in service in your water system.
Please maintain a copy of this letter with your permanent records for future reference.
Construction without Plan Approval
It is our understanding that the Mayflower Tank #1 (ST019) was constructed without receiving the required Plan Approval by the Division. Please be advised that the construction of public
water system facilities requires obtaining Plan Approval prior to construction and an Operating Permit after completion [R309-105-6]. A public water system operating a facility without
meeting the construction requirements can be assessed 50 Improvement Priority System (IPS) deficiency points for construction (and operation) without proper approval [R309-400-11]. These
IPS points are considered a significant deficiency and therefore reportable to the EPA and subject to additional points if not resolved in a timely manner [R309-400-11(6)(a)].
