PURPOSE AND SCOPE:
The subject property (site) is a warehouse building owned by D-3 LLC. The warehouse was previously leased
by Stone Castle LLC which ran a recycling facility for electronic and universal waste. This waste included
Cathode Ray Tube (CRT) glass with hazardous levels of lead. (See DSHW-2013-0032140) Stone Castle
abandoned the waste and D-3 LLC, the owner of the site, was issued a Stipulation and consent order from the
Director (DSHW-2021-008068) to remove 25% of the waste by each year, finishing September 2025 (DSHW-
2022-023025).
Site visits occur at this facility every two +/- months to monitor the proper removal and disposal of hazardous
waste at this facility.
NARRATIVE:
The inspectors arrived at building D3 and met Andy Renfro, the registered agent of Renfro Property
Management INC. There was visual evidence that waste had been removed from the site since the last visit.
Photos 01 and 02 in Attachment 1 show the progress that has been made since the last site visit on August 1,
2024.
Inspectors asked Andy for an update on the progress that had been made and he paraphrased his employee,
Nathan Murray, stating the 16 feet of waste from the south end of the warehouse has been removed. Andy also
stated that much of the winter months would be spent dismantling the plastic from the metal waste due to much
of the crushed glass having already been removed from the site. Andy climbed up onto some of the pallets to
get a better view of the waste. He then stated that there was still enough of the crushed glass for a few
shipments. (See Photos 03 - 06)
Andy provided a screenshot of a DOT Hazardous Materials General Awareness Training for Nathan Murray as
a follow up to a previous recommendation by inspectors. This training was completed on September 15, 2024,
and included as Photo 07.
Inspectors asked Andy about progress on his Annual and Biennial Reports. The Biennial Report had been
partially filled out on September 4, 2024, at a Department of Environmental Quality conference room. He
responded that he believed those to be completed. Inspectors told him that there was likely still information that
he needed from Chuck Lawrence, Clean Harbors Environmental Services, regarding waste information and
amounts. Andy agreed to look back at the documents, scan them, and send them to Sally for verification they
were complete and ready to be sent to dwmrcsumbit@utah.gov. The Annual Report has still not been received.
There was one Rolloff dumpster located just outside the East entrance to the warehouse that was covered and
properly labelled. (See Photo 08)
Also, outside on the East side of the building were nine pallets of boxed plastic scraps that were wrapped in
plastic wrap. Andy stated that these were placed here by Nate who allegedly sells these. Andy was unaware to
whom or for what purpose the plastic is being sold. (See Photo 09)
Next to the pallets of plastic were three empty IBC tanks with the tops cut off that had a dried black residue on
the inside. There was less than one inch of residue and was less than 0.3% of the weight capacity so the totes
were considered empty. Andy stated that the minimal residue was from mulch dye and that it was not
hazardous. (See Photo 10)
The next visit is scheduled to take place at Freeport Center on December 9, 2024.
