Re: TM Crushing, LLC – Temporary Relocation/Operation, Notice of Intent – Utah County
Your Notice of Intent dated November 11, 2024, to relocate portable aggregate equipment to the
temporary project for the Talons Cove Pit, located at 9502 North Mount Airey Drive, Eagle
Mountain, UT, was received by the Utah Division of Air Quality (DAQ) and has been reviewed.
The following equipment has been approved for operation for this temporary project:
Impact crusher
Cat 500 kW generator
Miscellaneous conveyors
The State of Utah has permitted portable aggregate equipment for operation in the State of Utah
on the Approval Order (AO) DAQE-AN132440008-18, dated March 22, 2018. The above
relocation address is a permanent aggregate facility with established production limits. All
equipment operating at this site must be in accordance with this site’s current AO
DAQE-AN144460004-19, dated August 5, 2019. The production of aggregate and hours of
operation from this temporary project when combined with the permanent equipment’s production
and hours of operation cannot exceed the 12-month rolling limits as per the applicable Conditions
II.B.1.a.A through II.B.1.a.G of this AO. The generator shall be operated using ultra-low sulfur
diesel fuel and with an opacity not to exceed 20%. As per Condition II.B.3.c of your portable AO
DAQE-AN132440008-18, this temporary equipment shall only operate between 6:00 AM and
10:00 PM each day. Any request for a change in these hours shall include modeling showing that
all National Ambient Air Quality Standards are met for this area.

The owner/operator shall maintain records of the actual operation hours, days, and production
rate, of the above referenced equipment at this relocation site and have the ability to submit the
information to the DAQ upon the request of representatives of the director. Please make certain
that the plant operator is aware of all the location specific requirements for this site and the
conditions of the aforementioned AO.
Federal New Source Performance Standards Subpart OOO requires that initial Method 9
observations be performed for all applicable portable crushers, screens, and attached conveyors.
Subpart OOO also mandates that all crushers constructed, modified, or reconstructed on or after
April 22, 2008, which are not enclosed, must install spray bars on the equipment and keep
maintenance records to ensure proper spray bar operations.
Utah Division of Water Quality Storm Water Permits and regulations may apply to this temporary
project. Please refer to Utah DEQ Water Quality’s current Storm Water Construction
requirements for additional information.
This approval for relocation in no way releases the owner or operator from any liability for
compliance with all other applicable federal, state, and local regulations including the UAC.

Hello, your relocation to Talon's Cove is in the signature process and should soon be issued. Just as a heads up, while
you requested an hours of operation time of between 5:00 a.m to 8 pm, Condition II.B.3.c limits portable equipment to the
hourly window of 6:00 am to 10:00 pm. If you need an earlier startup time you can request it from the Executive Director
after demonstrating that the 5:00 am startup doesn't pose an issue for the National Ambient Air Quality standards for your
surrounding area. Let me know if you have any questions, thanks.
