This Temporary Exception Expires on November 13, 2027.
Dear Stephen Shelley:
On November 13, 2024, the Division of Drinking Water (the Division) received your request for an exception to Rule R309-545-14 regarding the tank access opening for the East Tank (identified
as ST001 in the Division’s database) and West Tank (ST002). Rule R309-545-14(1) and (2) states:
“R309-545-14. Storage Tanks-Access Openings. Drinking water storage tanks shall be designed with reasonably convenient access to the interior for cleaning and maintenance.
(1) Height.
There shall be at least one opening above the level of the overflow, which shall be framed
at least 4 inches above the surface of the roof at the opening; or if on a buried tank, shall
be elevated at least 18 inches above any earthen cover over the tank. The frame shall be
securely fastened and sealed to the tank roof to prevent any liquid contaminant entering the tank. Concrete drinking water storage tanks shall have raised curbs around access openings,
formed and poured continuous with the pouring of the roof, and sloped to direct
water away from the frame.
(2) Shoebox Lid.
The frame of any access opening shall be provided with a close-fitting, solid shoebox type
cover that extends down around the frame at least 2 inches and is furnished with a gasket(s) between the lid and frame. The horizontal surface of the tank lid shall not have
any openings, cracks, or penetrations, such as a lock, keyhole, or bolted handle that would
allow contaminants to enter the tank.”
The basis for your request for an exception to Rule R309-545-14(1) and (2), Height and Shoebox Lid, is that the port located near the bottom of the tank is a gasketed and sealed opening
located greater than 18-inches above the ground surface. Also, the lid is vertical so any runoff or other surface water would not build up around the opening. Due to the size of the
tank and as part of the System’s operations and maintenance procedures, the tank would be drained and accessed through the port near the bottom of the tank for any cleaning and maintenance
as required. If cleaning is required, the surface shall be properly disinfected before opening the port. Also, the tank is located on private property in a remote area of the mountains
with limited public access. Based on this information, the intent of the rule to protect drinking water from potential contamination has been met.
On this basis, a temporary exception to Rule R309-545-14(1) and (2), Height and Shoebox Lid, is hereby granted for the East Tank (ST001) and West Tank (ST002), subject to the following
conditions:
This temporary exception expires on November 13, 2027.
You will be required to re-submit a temporary exception request along with confirmation that all conditions outlined in this temporary exception have been fulfilled and obtain an exception
renewal prior to November 13, 2027.
Exceptions granted by the Division include an expiration date to ensure that thebasis and conditions for granting the exception are verified periodically and that the drinking water
quality remains protected. After receiving your request, the Division will determine whether this exception can be re-issued.
Failure to request the re-evaluation of these exceptions and obtain an exception renewal by November 13, 2027, will result in the activation of the deficiency related to not having an
access opening for cleaning and maintaining the East Tank (ST001) and West Tank (ST002).
Your System has committed to following the Divisions protocol for Plan Approval so that when these tanks are replaced, they will be replaced by tanks that meet all the R309-545 requirements.
To ensure the storage tank lid is still providing an equivalent degree of protection of the drinking water, the System will continue to collect the required monthly routine sampling
of their System.
This temporary exception may be rescinded any time if new evidence indicates that the conditions of this exception are no longer being met or a public health risk exists due to this
exception.

The basis for your request for an exception to R309-515-7(7)(e) is that Silver Lake Summer Home’s Private Spring (WS001) is located within the boundaries of the Uinta-Wasatch-Cache National
Forest and the Forest Service will not allow Silver Lake Summer Homes to install a fence. The spring is located 100 yards from the Lone Peak Wilderness Area where no grazing is allowed
on the Forest Service property or Wilderness Area. The Silver Lake Summer Home Association will monitor the spring area to ensure that there will be no potential problems and work with
the Forest Service to maintain the area. The system bacteriological sampling record shows no positive total coliform samples since 2007.
On this basis, an exception to R309-515-7(7)(e), Fencing of the Spring Collection Area, is hereby granted subject to the homeowner’s association conducting periodic inspections of the
spring area. At a minimum, the spring collection area shall be inspected at the start up and shut down of each operating season. The exception to R309-515-7(7)(e), Spring Fencing, is
hereby granted
for the Private Springs (WS001), subject to the following conditions:
This exception expires on November 13, 2027.
This water system is required to comply with the following source water monitoring for the Private Springs (WS001) at sampling locations that are prior to treatment:
Take monthly source bacteriological samples for the months this source is accessible for 18 months.
The sampling location of the source water bacteriological samples needs to be labeled as WS001.
The source bacteriological sampling is in addition to the monthly total coliform sampling in the distribution system (DS001) that has been in place for your water system.
In case of E. coli positive bacteriological sample result, contact Sitara Federico at (385) 515-1459 or sfederico@utah.gov within 24 hours of notification from the laboratory.
The source water monitoring requirements intend to gather data to evaluate the quality of this source and determine if the data supports the issuance of an exception for the Spring Fencing.
It is recommended that you conduct monthly (or more frequent inspections) of the spring collection area and maintain records of the inspections. Records of the inspections may be reviewed
during sanitary surveys. Sample and blank inspection logs are attached for your use.
You will be required to re-submit an exception request including confirmation that all conditions outlined in this temporary exception have been fulfilled and obtain an exception renewal
prior to November 13, 2027.
Exceptions granted by the Division include an expiration date to ensure that the basis and conditions for granting the exception are verified periodically and that the drinking water
quality remains protected. After receiving your request, the Division will determine whether this exception can be re-issued.
Failure to request the re-evaluation of this exception and obtain an exception renewal by November 13, 2027, will result in the activation of the deficiency related to not having a permanent
flow measuring device on springs.
This Temporary Exception may be rescinded any time if new evidence indicates that the conditions of this exception are no longer being met or a public health risk exists due to this
exception.
