This Temporary Exception Expires on November 30, 2027.
Dear Max Covey:
On October 1, 2024, the Division of Drinking Water (the Division) received your renewal request for an exception to Rule R309-545-14(2)regarding the requirement for a shoebox style hatch
on the clearwell at Keetley WTP (identified as TP003 in the Division’s database). This exception was first granted on October 18, 2021. The need for this exception was first identified
during the 2021 sanitary survey.
The Rule R309-545-14(2) states “The frame of any access opening shall be provided with a close-fitting, solids shoebox-type cover that extends down around the frame at least 2 inches
and is furnished with a gasket(s) between the lid and the frame. The horizontal surface of the tank shall not have any openings, cracks, or penetrations, such as a lock, keyhole, or
bolted handle that would allow contaminants to enter the tank”.
The clearwell is located inside of the Keetley WTP (TP003) building. It has a flat hatch on a raised concrete curb that accesses the clearwell. There are welded handles on the hatch,
it does not have any penetrations.
Exception Request
The basis for your request for an exception to R309-545-14(2) is that the clearwell hatch is located inside of the water treatment plant with a raised concrete curb. You propose that
due to the hatch being inside of the water treatment plant, it is not exposed to the elements such as snow, rain, ice, and windstorms. Additionally, with the hatch being raised off the
floor there is little chance for anything inside the building to wash into the clearwell. As no public health risks were identified due the exception, it will be renewed for another
three years.
On this basis, an exception to R309-545-14(2), Shoebox Hatch for Clearwell, is hereby renewed for the Keetley WTP (TP003).
This Temporary Exception expires on November 30, 2027.
You will be required to re-submit an exception request along with confirmation that all conditions outlined in this temporary exception have been fulfilled and obtain an exception renewal
prior to November 30, 2027.
Exceptions granted by the Division include an expiration date to ensure that the basis and conditions for granting the exception are verified periodically and that the drinking water
quality remains protected. After receiving your request, the Division will determine whether this exception can be re-issued.
Failure to request the re-evaluation of this exception and obtain an exception renewal by November 30, 2027, will result in the activation of the deficiency related to not having a shoebox
style lid on the clearwell of the Keetley WTP (TP003).
This Temporary Exception may be rescinded any time if new evidence indicates that the conditions of this exception are no longer being met or a public health risk exists due to this
exception.The issuance of this exception temporarily resolves your water system’s deficiency of V010 related to not having a shoebox style lid on the clearwell of the Keetley WTP (TP003).
