Rogers, Director of Regulatory Affairs 299 South Main Street, Suite 1700 Salt Lake City, UT 84111 RE:Request for Information (RFI) - Apparent ViolationRadioactive Materials License UT 2300249 Dear Mr. Rogers: This notice is being sent for your attention as a representative of EnergySolutions, LLC(the Respondent). According to the Division of Waste Management and Radiation Control’s (Division) records, you are the designated contact person for the Respondent. On April 10, 2024 the Division received the 2023 Second Semi-Annual Environmental Monitoring Report (DRC-2024-005257; CD-2024-081)concerningthe Respondent’s facility. The submission of this report to the Division is a requirement ofRadioactive Materials License UT 2300249(the License),License Condition 29.A. Based on observations and information obtained during the review of the 2023 Second Semi-Annual Environmental Monitoring Report, the Director of the Division (Director)is requesting that the Respondentprovide response to our Request for Information (RFI) relating to thiscompliance issue as well as an opportunity to correct this apparent compliance issue:Utah Administrative Code R313-15-301(1)(a)requires “The total effective dose equivalent to individual members of the public from the licensed or registered operation does not exceed one mSv (0.1 rem) in a year, exclusive of the dose contributions from background radiation, from any medical administration the individual has received, from exposure to individuals administered radioactive material and released, under Rule R313-32 (incorporating 10 CFR 35.75 by reference), from voluntary participation in medical research programs, and from the licensee's or registrant's disposal of radioactive material into sanitary sewerage in accordance with Section R313-15-1003” (italicized for emphasis) In the above-mentioned report, the Respondent demonstrated that for the year 2023, the public’s Total Effective Dose Equivalent at Air Sampling Station A-28 was 160.7 mrem/year assuming a 25% occupancy factor. This reported value is an exceedance of Public Dose Limits set forth in Utah Administrative Code R313-15-301(1)(a). Within 30 days, please submit the following requested documentation regarding this Apparent Violation and associated corrective actions to the Director: the cause of each compliance issue; the specific corrective actions taken, results achieved, and applicable dates; if future corrective actions are proposed, the specific corrective actions and proposed completion dates, including intermediate milestones, as applicable; and how the corrective actions will prevent similar compliance issues from recurring.
