The CAP is in general compliance with Utah Admin. Code R311-211 and R311-202. The DERR makes no guarantee, implied or otherwise, that the approved CAP will be successful in obtaining established cleanup levels. In the event that the CAP does not meet the cleanup goals, further work at the facility may be required prior to site closure consideration. The public notification process has been successfully completed. There was no substantial public interest or other reason to warrant a public meeting prior to CAP approval or implementation of the cleanup activities . The CAP is approved and will consist of identifying the location of petroleum impacted soil, followed by the excavation, removal, and documentation of the proper disposal of the residual petroleum impacted soils related to the former heating oil tank at the referenced location. Confirmation soil samples will be collected from the walls and floor of the excavation(s) and analyzed for BTEXN and DRO per appropriate analytical methods. CAP reporting will include a detailed description of the activities conducted, location maps, scaled excavation maps showing sample locations, laboratory reports, summary tables, soil disposal documentation, photographs, etc. Additionally, if all confirmation samples do not have non-detectable levels of contaminants, an estimate of remaining soil impacts must be presented, along with a map indicating the approximate location of any soil with residual petroleum concentrations above laboratory detection levels. Facility ID# 4002449 Page 2 The projected start date is November 4, 2024. If this schedule has changed, please contact your DERR project manager with an updated implementation schedule. Written modifications to the above CAP/conditions must be reviewed and approved by the Division Director prior to their implementation. The local health department must be notified 72 hours before beginning corrective action activities. Cleanup levels for this release have been established as DERR’s Initial Screening Levels using criteria outlined in Utah Admin. Code R311-211. These levels are expected to be protective of all receptors within a critical distance at the site considering an anticipated future land use which may include residential. It may be necessary to reevaluate the cleanup levels if additional information becomes available or if the land use or other conditions change in the future. The CAP construction or implementation should begin within 90 days of your receipt of this approval letter. If corrective action has not begun by April 1, 2025, a revised CAP must be submitted for approval. Please submit a corrective action report detailing the cleanup activities and sample results within 60 days after the corrective action is complete. Once it has been adequately demonstrated that contaminant concentrations are below the established cleanup levels, you may petition the DERR for release closure. After reviewing this information, the DERR will determine if no further action is warranted or if additional work is needed.
