SUBJECT: Memo to File Regarding Responsible Parties
Former Interstate Brands Facility, 2557 Grant Avenue, Ogden, Utah
Facility Identification No. 1200029, Release OLZ
I have reviewed the file for the former Interstate Brands Facility (IBF) petroleum release, including
information obtained by the Division of Environmental Response and Remediation (DERR) and
others. The review indicates that the above-referenced facility (the Site) is not in compliance with
Utah Admin. Code R311-202, which requires investigation and or remediation of contamination
associated with releases from Underground Storage Tanks (USTs). Based on an evaluation of
information submitted to date, the DERR has determined that the Ogden Redevelopment Agency
(RDA), the landowner, is not a Responsible Party (RP) to the discovered UST contamination.
As such, I recommend that the DERR issue work assignments to conduct a formal property title
search to evaluate potential historic RPs, and to perform a subsurface investigatio n utilizing Federal
or State Funds. If RPs are discovered, the DERR may proceed to recover all expenditures associated
with investigation, abatement or corrective action at the Site, as provided in Utah Code Ann., 19-6-
420 (2)(b)(iv).
