Emery County Coal Resources, Inc. – Lila Canyon Mine PO Box 910 East Carbon, Utah 84520 jessecandelaria@acnrinc.com Subject: Renewal of UPDES Permit No. UT0026018 Emery County Coal Resources, Inc. – Lila Canyon Mine Dear Jesse: The above-referenced Utah Pollutant Discharge Elimination System (UPDES) permit will expire next year at this time on November 30, 2025. The Division of Water Quality (DWQ) likes to provide facilities with ample notice to complete and submit the required permit application forms well in advance of the expiration date to help facilitate an on-time permit renewal. Pursuant to Utah Administrative Code R317-8-3.1(4), all UPDES permittees must apply for reissuance of the permit not less than 180 days prior to the expiration date of the existing permit. A copy of the DWQ UPDES application forms may be found at https://deq.utah.gov/water-quality/updes-permitting-program#individual. From there, expand the “Individual Permits” tab and click on “UPDES Permit Application Forms” to find the UPDES Industrial Permit Application and Table forms. Please note that the forms may have changed since your last permit renewal. Please complete and return the Industrial Permit Application form and any applicable Table forms to DWQ as soon as possible, but no later than March 1, 2025, so that we can begin to process your permit for an on-time renewal. Failure to provide the completed UPDES Permit Application information to DWQ at least 180 days prior to current permit expiration may result in a lapse of permit coverage for your facility and would thereby be a violation of the Utah Water Quality Act for any subsequent discharges. Per Utah Code § 19-5-115, discharges of wastewater or pollutants occurring without a UPDES permit could be subject to a civil penalty of $10,000 per day of violation.
