Dear Ms. Weinel: The Division of Waste Management and Radiation Control (DWMRC) has reviewed the Energy Fuels
Resources (USA) Inc. (EFR) May 3, 2021 Transmittal of Revised Spill Prevention, Control, and
Countermeasures Plan (SPCC) and Revised Stormwater Best Management Practices Plan (SWBMPP)
for the White Mesa Uranium Mill. The EFR transmittal includes redline strikeout and clean versions of each document.
The revisions include changes made to: “1. Update personnel, contact, and storage information”, and
“2. Correct typographical errors.” DWMRC notes that the SPCC contact information for the Lakewood, Colorado personnel was updated to remove the Chief Operating Officer as a needed contact in the event of spill required reporting and update the title of the Vice President of Regulatory Affairs. DWMRC notes that the SPCC Table 4.0 has been amended to include barium chloride, hydrochloric
acid, and rare earth carbonates, and that for storage of rare earth carbonates the SPCC specifies that “the
Mill’s products are not stored in the Reagent Yard itself but are present in containers in the Mill
Buildings and/or Mill Yard.” All other changes to the SPCC and SWBMPP appear to be typographical, and readability related.
Based on the review, it appears that the changes made are appropriate and reasonable and the revised
May 3, 2021 SPCC and SWBMPP are hereby approved. (Over)
